Provisions on the Administration of Energy Conservation for Civil Buildings Order of the Ministry of Construction (No. 143) The “Provisions on the Administration of Energy Conservation for Civil Buildings”, which were deliberated and adopted at the 76th executive meeting of the Ministry on October 28, 2005, are hereby promulgated, and shall come into force on January 1, 2006. Wang Guangtao, Minister of Construction November 10, 2005 Provisions on the Administration of Energy Conservation for Civil Buildings Article 1 The present Provisions are formulated in accordance with the “ Law of the People's Republic of China on Energy Conservation ”, the “ Construction Law of the People's Republic of China ” and the “ Regulation on the Administration of the Quality of Construction Projects ” for the purpose of strengthening the administration of energy conservation for civil buildings, enhancing the efficiency of energy utilization, and improving the indoor heat environment quality. Article 2 “Civil buildings” as mentioned in the present Provisions shall refer to residential buildings and public buildings. “Energy conservation for civil buildings” as mentioned in the present Provisions shall refer to the activities of rationally and effectively utilizing energy in the process of planning, designing, building or using civil buildings by means of adopting new wall materials, implementing the standards for energy conservation for buildings, strengthening the operation and management of the energy-consuming equipment for buildings, rationally designing the thermal engineering performance of the surrounding structures of buildings, improving the work efficiency of heating, cooling, illumination, ventilation, water supply, drainage and passage systems, as well as utilizing renewable energy, and reducing energy consumption of buildings on the premise of guaranteeing the functions of buildings and the quality of indoor heat environment. Article 3 The construction administrative department of the State Council shall take charge of supervising and administering the energy conservation for civil buildings throughout China. The construction administrative department of a local people's government at the county level or above shall take charge of supervising and administering the energy conservation for civil buildings within its own jurisdiction. Article 4 The construction administrative department of the State Council shall, according to the energy conservation planning of the state, make the special planning of the state on energy conservation for buildings. The construction administrative department of the people's government of each province, autonomous region, municipality directly under the Central Government, or districted municipality shall, according to the energy conservation planning of the locality, make a special planning of the locality on energy conservation for buildings, and organize the implementation thereof. Article 5 Whoever makes an urban and rural planning shall fully consider the comprehensive utilization and conservation of energy and resources, as well as make research the effects of the planning to the urban layout, functional areas, construction features, and infrastructures. Article 6 The construction administrative department of the State Council shall, on the basis of the development situation of energy conservation for buildings and in compliance with the principles of using advanced technologies, being economic and rational, organize the formulation of relevant standards for energy conservation for buildings, build up and improve the system of standards for energy conservation for buildings. The construction administrative department of the people's government of each province, autonomous region, or municipality directly under the Central Government shall strictly implement the relevant provisions of the state on energy conservation for civil buildings, and may formulate local standards which are stricter than the national ones for energy conservation for civil buildings, or the detailed rules for the implementation thereof. Article 7 The scientific research and technological development on energy conservation for civil buildings shall be encouraged. The buildings, structures, materials and energy-consuming equipment of energy efficient conservation type, the auxiliary facilities and corresponding construction undertaking techniques, applied technologies and management technologies shall be popularized. The development and utilization of renewable energy shall be promoted.
