Regulation of the People's Republic of China on Civil Aviation Security (2011Revision)
Regulation of the People's Republic of China on Civil Aviation Security
(Issued by the Order No. 201 of the State Council of the People's Republic of China on July 6, 1996; amended in accordance with the Decision of the State Council on Abolishing and Amending Some Administrative Regulations by theOrder No. 588 of the State Council of the People's Republic of China on January 8, 2011)
Chapter I General Provisions
Article 1 These Regulations are formulated for the purpose of protecting civil aviation activities against unlawful interference, maintaining the order of civil aviation and ensuring the safety of civil aviation.
Article 2 These Regulations are applicable to all civil aviation activities and to the units and individuals related to civil aviation activities within the territory of the People's Republic of China.
These Regulations are applicable to the civil aircraft with the nationality of the People's Republic of China engaged in civil aviation activities outside the territory of the People's Republic of China, unless it is otherwise provided for in the international treaties concluded or acceded to by the People's Republic of China.
Article 3 The principles of unified administration and division of responsibilities shall be followed in the work of safety and security of civil aviation.
The public security organs for civil aviation (hereinafter referred to as the public security organs for civil aviation) shall be responsible for the unified administration, inspection and supervision of the work of safety and security of civil aviation.
Article 4 The relevant local people's governments and civil aviation units concerned shall cooperate closely in maintaining civil aviation safety.
Article 5 Passengers, consignors, consignees and other persons entering an airport shall comply with the laws, regulations and rules governing civil aviation security control.
Article 6 Civil airport operators and civil aircraft operators shall perform the following functions and duties:
(1) making civil aviation safety and security programmes of their own units and submitting them to the competent civil aviation department of the State Council for the record;
(2) implementing strictly the relevant civil aviation safety and security measures;
(3) carrying out regular civil aviation safety and security training and promptly removing hidden dangers to the safety and security of civil aviation.
Foreign civil aviation enterprises that operate air services to the People's Republic of China shall submit their civil aviation safety and security programmes to the competent civil aviation department of the State Council.
Article 7 Citizens have the right to report to the civil aviation public security organs any premeditated plots to hijack or destroy civil aviation aircraft or any other acts that endanger civil aviation safety.
Article 8 Rewards shall be given by the people's governments concerned or the competent civil aviation department of the State Council to units or individual that have made outstanding contributions to maintaining civil aviation safety.
Chapter II Safety and Security Measures at Civil Airports
Article 9 The construction, renovation or expansion of civil airports (including the civilian parts in those airports jointly-used by military and civilian units) shall conform to the provisions governing the construction of civil airport safety and security facilities by the competent civil aviation department of the State Council.
Article 10 A civil airport that is to be opened for use shall satisfy the following safety and security requirements:
(1) It has established a controlled airport area with full-time security personnel;
(2) It has established standard protective fence and patrol passages;
(3) It has established a safety and security unit with corresponding personnel and equipment;
(4) It has established a security check and corded unit with the personnel and checking equipment corresponding to the traffic volume of the airport;
(5) It has established a full-time fire-fighting organization with the personnel and equipment in accordance with the fire protection grade of the airport;
(6) It has formulated an emergency plan and has necessary emergency rescue equipment.
Article 11 The airport controlled area shall, in accordance with the safety and security requirements, be divided into departure sterile area, baggage sorting, loading and unloading area, aircraft moving area, maintenance area and cargo storage area, etc. Safety and security protection facilities and distinct signs shall be set up respectively.
Article 12 Strict safety and security measures shall be established for the controlled area at the airport, and the area shall be controlled in the manner of zonal segregation and closure. The specific measures of administration shall be f......
