Regulation on the Administration of Emergency Responses to Nuclear Accidents of Nuclear Power Plants
(Promulgated by Order No. 124 of the State Council of the People's Republic of China on August 4, 1993; amended in accordance with the Decision of the State Council on Abolishing and Amending Some Administration Regulations by the Order No. 588 of the State Council of the People's Republic of China on January 8, 2011)
Chapter I General Provisions
Article 1 This Regulation is developed for purposes of strengthening the emergency management of nuclear accidents at nuclear power plants, and controlling and reducing the hazards of nuclear accidents.
Article 2 This Regulation is applicable to the emergency management of nuclear accidents at nuclear power plants (hereinafter referred to as “nuclear accidents”) that are likely to cause or have caused release of radioactive substances and significant radiological consequences.
Article 3 The emergency management of nuclear accidents shall be implemented under the guidelines of constant vigilance, versatile compatibility, unified command, active coordination, public safeguard, and environmental protection.
Chapter II Emergency Institutions and Their Responsibilities
Article 4 The department designated by the State Council shall take charge of the emergency management of nuclear accidents nationwide, and its main responsibilities include:
(1) drafting national policies for nuclear accident emergency preparedness;
(2) uniformly coordinating the nuclear accident emergency work of the relevant departments under the State Council, the army, and local people's governments;
(3) organizing the development and implementation of the national emergency plans for nuclear accidents, and reviewing and approving the off-site emergency plans for nuclear accidents;
(4) approving the initiation and termination of the off-site emergency condition in due time;
(5) making suggestions on implementing nuclear accident emergency response actions; and
(6) reviewing and approving the bulletins and international notifications on nuclear accidents, and proposing plans for requesting international assistance.
If necessary, the State Council shall lead, organize, and coordinate the emergency management of nuclear accidents nationwide.
Article 5 Departments designated by people's governments of provinces, autonomous regions and municipalities directly under the Central Government where the nuclear power plants are located shall take charge of the emergency management of nuclear accidents within their respective administrative regions, and their main responsibilities include:
(1) implementing the laws, regulations and policies of the state for the nuclear accident emergency work;
(2) organizing the development of off-site emergency plans for nuclear accidents and performing well nuclear accident emergency preparedness;
(3) uniformly commanding off-site nuclear accident emergency response actions;
(4) organizing support for the nuclear accident emergency response actions; and
(5) notifying the adjacent provinces, autonomous regions, and municipalities directly under the Central Government of the information on nuclear accidents in a timely manner.
If necessary, the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall lead, organize, and coordinate the emergency management of nuclear accidents within their respective administrative regions.
Article 6 The main responsibilities of the nuclear accident emergency institutions of nuclear power plants include:
(1) implementing the laws, regulations and policies of the state for the nuclear accident emergency work;
(2) developing on-site emergency plans for nuclear accidents and performing well nuclear accident emergency preparedness;
(3) determining the level of the nuclear accident emergency condition and uniformly commanding the nuclear accident emergency response actions in their plants;
(4) reporting the information on accidents to the senior competent authorities, the nuclear safety department under the State Council, and departments designated by the provincial people's governments, and making suggestions on initiating the off-site emergency condition and taking emergency protection measures; and
(5) assisting and cooperating with the departments designated by the provincial people's governments in effectively conducting the emergency management of nuclear accidents.
Article 7 The senior competent authority of a nuclear power plant shall lead the nuclear accident emergency work of the nuclear power plant.
The nuclear safety department, the environmental protection department, the health department, and other relevant departments under the State Council shall, within the scope of their respective responsibilities, effectively conduct corresponding nuclear accident emergency work.
Article 8 As the important force in nuclear accident emergency activities, the Chinese People's Liberation Army shall provide effective support in emergency response to nuclear accidents.
Chapter III Emergency Preparation
Article 9 For nuclear accidents that may occur in nuclear power plants, the nuclear accident emergency institutions of nuclear power plants, departments designated by the provincial people's governments, and the department designated by the State Council shall develop emergency plans for nuclear accidents in advance.
The emergency plans for nuclear accidents include on-site emergency plans for nuclear accidents, off-site emergency plans for nuclear accidents, and national emergency plans for nuclear accidents. The emergency plans for nuclear accidents at all levels shall be connected and coordinated with one another.
Article 10 The on-site emergency plans for nuclear accidents shall be developed by the nuclear accident emergency institutions of nuclear power plants, and shall, after being reviewed by their competent authorities, be submitted to the nuclear safety department under the State Council for evaluation, and reported to the department designated by the State Council for recordation.
Article 11 The off-site emergency plans for nuclear accidents shall be developed by the departments designated by the provincial people's governments at the places where the nuclear power plants are located, and submitted to the department designated by the State Council for review and approval.
Article 12 The national emergency plans for nuclear accidents shall be developed by the department designated by the State Council.
Relevant departments under the State Council and the headquarters of the Chinese People's Liberation Army shall, according to the national plans for nuclear accidents, develop corresponding emergency programs for nuclear accidents, and submit them to the department designated by the State Council for recordation.
Article 13 On-site emergency plans and off-site emergency plans for nuclear accidents shall include:
(1) basic tasks of nuclear accident emergency work;
(2) nuclear accident emergency response organizations and their responsibilities;
(3) the scope of the smoke plume emergency planning zone and the ingestion emergency planning zone;
(4) the intervention level and the derived intervention level;
(5) detailed plans for nuclear accident emergency preparations and response;
