Interim Regulations on Requirement for Mining Enterprise Leaders to Descend into Mine Pits with Mine Workers on Regular Shifts, and Supervision and Inspection over Metal and Non-metal Underground Mines (2015 Revision) Interim Regulations on Requirement for Mining Enterprise Leaders to Descend into Mine Pits with Mine Workers on Regular Shifts, and Supervision and Inspection over Metal and Non-metal Underground Mines (Issued by the Order No. 34 of the State Administration of Work Safety on October 13, 2010, amended in accordance with the Order No. 78 of the State Administration of Work Safety on May 26, 2015) CHAPTER I GENERAL Article 1 These Regulations are formulated in accordance with the Notice of the State Council on Further Strengthening Safe Production of Enterprises (State Council [2010] No. 23) and relevant State regulations in order to implement the regulations on requirement for mining enterprise leaders of metal or non-metal underground mines to descend into mine pits with mine workers on regular shifts, to strengthen onsite work safety management and to promptly detect and eliminate potential hazards. Article 2 These Regulations shall apply to metal and non-metal underground mining enterprises (hereinafter called the "mining enterprises") whose leaders are required to descend into mine pits with mine workers on regular shifts, and to the supervision and inspection over the enterprises by those Supervisory Authorities at county and above levels of work safety. Article 3 Mining enterprises referred to in these Regulations are those metal and non-metal underground mining and production enterprises and all subordinate mines with independent production, as well as those mines newly constructed, undergoing rebuilding, expansion or technical modification etc. Mining enterprise leaders referred to in these Regulations are those persons in charge of the mining enterprises, members of their leadership and management team, chief engineers and deputy chief engineers. Article 4 The mining enterprise is the principal entity responsible for implementing the regulations on requirement for mining enterprise leaders to descend into mine pits with mine workers on regular shifts and it shall be ensured that for each shift, there is at least one leader descending into the mine pits with the shift workers and the leader shall descend and ascend along with the shift workers at the same time. Persons holding key positions of the mining enterprises shall be fully responsible and obligated for implementing the regulations on requirement for mining enterprise leaders to descend into mine pits with mine workers on regular shifts. Article 5 Work safety supervision and administration authorities shall oversee and inspect over the implementation of the regulations on requirement for mining enterprise leaders to descend into mine pits with mine workers on regular shifts among mining enterprises and duly make necessary decisions or impose administrative penalties onsite. Relevant authorities of the industry shall fulfill their own duties and responsibilities relating to implementation of the regulations on requirement for mining enterprise leaders to descend into mine pits with mine workers on regular shifts based on provisions of the Notice of the State Council on Further Strengthening Safe Production of Enterprises and provide cooperation to the work safety supervision and administration authorities to carry out supervision and inspections over the implementation of regulations on requirement for mining enterprise leaders to descend into mine pits with mine workers on regular shifts and related evaluation, incentive and penalty systems. Article 6 Any enterprise or individual detecting failure of the mining enterprise leaders to follow the regulations to descend into mine pits with mine workers on regular shifts or any fraudulent behavior therein, has right to inform and report the case to the work safety supervision and administration authorities. Rewards shall be awarded for truthful information provided and reported. CHAPTER II DESCENDING INTO MINE PITS WITH MINE WORKERS ON REGULAR SHIFTS Article 7 Mining enterprises shall establish and improve measures taken for implementation of regulations on requirement for mining enterprise leaders to descend into mine pits with mine workers on regular shifts and establish evaluation, incentive and penalty schemes and monthly plans for the implement......
