Notice of the General Office of the State Council on Issuing the Measures for the Administration of Emergency Response Plans Notice of the General Office of the State Council on Issuing the Measures for the Administration of Emergency Response Plans (No. 101 [2013] of the General Office of the State Council) The people's governments of all provinces, autonomous regions and municipalities directly under the Central Government; and all ministries and commissions of the State Council and all institutions directly under the State Council: The Measures for the Administration of Emergency Response Plans have been approved by the State Council and are hereby issued to you for your compliance and implementation. General Office of the State Council October 25, 2013 Measures for the Administration of Emergency Response Plans Chapter I General Provisions Article 1 In order to regulate the administration of emergence response plans for emergencies (hereinafter referred to as “emergency response plans”), and strengthen the pertinence, practicability and operability of emergency response plans, these Measures are formulated in accordance with the Emergency Response Law of the People's Republic of China , and other laws and administrative regulations. Article 2 The term “emergency response plans” under these Measures refers to the work plans formulated by people's governments at all levels, the departments thereof, grassroots organizations, enterprises, institutions, social organizations and other entities in advance in order to respond to emergencies in accordance with law and in a prompt, scientific and orderly manner, and reduce emergencies and resulting damage to the greatest extent possible. Article 3 These Measures shall apply to the planning, compilation, examination, approval, issuance, recordation, drill, revision, training, publicity, education and other work on emergency response plans. Article 4 The administration of emergency response plans shall follow the principles of uniform planning, categorized guidance, hierarchical responsibility and dynamic administration. Article 5 For compilation of emergency response plans, contents shall be reasonably determined in accordance with relevant laws, administrative regulations and rules, and in close combination with reality in order to enhance pertinence, practicability and operability in an effective manner. Chapter II Categorization and Contents Article 6 According to the entities formulating the plans, emergency response plans shall be divided into two categories, emergency response plans of governments or departments thereof, and emergency response plans of entities or grassroots organizations. Article 7 Emergency response plans of governments or departments thereof shall be formulated by the people's governments at all levels or the departments thereof, which shall include the overall emergency response plans, special-purpose emergency response plans, departmental emergency response plans and other emergency response plans. An overall emergency response plan is the master program in the emergency response plan system, which shall consist of the general rules and arrangements of a government for organization of responses to emergencies and shall be formulated by a people's government at or above the county level. A special-purpose emergency response plan is a work plan involving multiple departmental functions formulated by a government in advance in order to respond to emergencies of a certain kind or certain kinds, or for protection of important targets, guarantee of major events, guarantee of emergency response resources and other important work of a special purpose. A relevant department shall take the lead in formulating such plan, which shall be submitted to the people's government at the same level for issuance and implementation upon its approval. A departmental emergency response plan is a work plan formulated by the relevant department of a government in advance in accordance with the overall emergency response plan, special-purpose emergency response plans and functions of the department in order to respond to emergencies in the department (industry or area), or for protection of important targets, guarantee of major events, guarantee of emergency response resources and other work involving the department. Such plan shall be formulated by the relevant department of a government at any level. The people's governments and relevant departments thereof of adjacent or nearby places shall be encouraged to jointly formulate joint emergency response plans for emergencies in the region or river basin. Article 8 Overall emergency response plans shall primarily provide for the basic principles, organizational systems and operating mechanisms for response to emergencies, and the overall arrangements for emergency response guarantees, and clarify the functions and tasks of all relevant parties. Special-purpose or departmental emergency response plans for response to emergencies shall prioritize different contents at different levels. Special-purpose or departmental emergency response plans at the national level shall give priority to clarification of the principles for response to emergencies, organization and command mechanisms, standards for classification of early warnings and emergencies, requirements for information reporting, classified responses, response actions, emergency response guarantee measures and other contents, with the focus on regulating response actions at the national level while at the same time embodying the policy nature and guiding effect. Special-purpose or departmental emergency response plans at the provincial level shall give priority to clarification of organization and command mechanisms for emergencies, requirements for information reporting, classified responses, response actions, team and supply guarantees and mobilization procedures, functions of governments at the city or county level and other contents, with the focus on regulating response actions at the provincial level while at the same time embodying the guiding effect. Special-purpose or departmental emergency response plans at the city or county level shall give priority to clarification of organization and command mechanisms for emergencies, risk evaluation, monitoring, early warning, information reporting, emergency response measures, team and supply guarantees and mobilization procedures and other contents, with the focus on regulating response actions at the city (prefecture) level and the county level, and embodying the functions of entities in emergency response. Special-purpose or departmental emergency response plans of towns and neighborhoods shall give priority to clarification of the spread of early warning information for emergencies, organization of responses in early stages, self-rescue and rescue of others, collection and reporting of information, temporary personnel placement and other contents, with the focus on regulating response actions at the township level, and embodying the characteristics of responses in early stages.
