Measures for the Administration of New Feeds and New Feed Additives (2012) Order of the Ministry of Agriculture (No. 4 [2012]) The Measures for the Administration of New Feeds and New Feed Additives, as deliberated and adopted at the 6th executive meeting of the Ministry of Agriculture in 2012, are hereby issued and shall come into force on July 1, 2012. Minister: Han Changfu May 2, 2012 Measures for the Administration of New Feeds and New Feed Additives Article 1 For purposes of strengthening the administration of new feeds and new feed additives and guaranteeing the quality and safety of breeding animal products, these Measures are formulated in accordance with the Regulation on the Administration of Feeds and Feed Additives . Article 2 The term “new feeds” as mentioned in these Measures refers to single feeds that have been researched and developed within the territory of China and have not yet been approved for use. The term “new feed additives” as mentioned in these Measures refers to the feed additives that have been researched and developed within the territory of China and have not yet been approved for use. Article 3 Under any of the following circumstances, an applicant shall file an application for examination and approval with the Ministry of Agriculture. The Ministry of Agriculture shall review the application by referring to the examination and approval procedures for new feeds and new feed additives as prescribed in these Measures. Where the application passes the review, the Ministry of Agriculture shall issue an announcement that the related new feeds and new feed additives shall be produced and used as feeds and feed additives, but the certificates for new feeds or feed additives shall not be issued. (1) the application scope of feed additives is enlarged; (2) the content standard of feed additives is lower than that required for the safe use of feed additives, except where the feed additives are prepared with carriers or diluter based on a certain proportion; (3) there are material changes in the production technology of feed additives; (4) a new feed or new feed additive is not put into production three years after the certificate for such new feed or new feed additive is acquired, and any other enterprise applies for the production of such new feed or new feed additive; or (5) any other circumstance as prescribed by the Ministry of Agriculture. Article 4 The research and development of new feeds and new feed additives shall follow the principles of science, safety, effectiveness and environmental protection, and guarantee the quality and safety of new feeds and new feed additives. Article 5 The Ministry of Agriculture shall be responsible for the examination and approval of new feeds and new feed additives. The National Feed Review Committee shall organize review of the safety and effectiveness of new feeds or new feed additives, and their impact on the environment. Article 6 Before a new feed or new feed additive is put into production, the developer or producing enterprise (hereinafter referred to as the “applicant”) shall file an application for examination and approval with the Ministry of Agriculture and submit the application materials and samples of such new feed or new feed additive. Article 7 The application materials shall include the following: (1) the application form for the examination and approval of a new feed or new feed additive; (2) the product name and naming basis, and purposes of the research and development of the product; (3) the identification report on the active constituents and chemical structure, and the physical and chemical properties, or the classified identification report on animals, plants, and microbes; for the microbe products or fermented goods, the bacterial strain collection number as issued by national culture collection institutions designated by the Ministry of Agriculture; (4) the application scope, usage methods, recommended dosage for compound feeds or total mixed ration, and when necessary, the maximum quantity; (5) the production technology, manufacturing methods, and reports ......
