Administrative Measures for the Import and Export of Explosives for Civil Purposes Order of the Ministry of Industry and Information Technology, the Ministry of Public Security and the General Administration of Customs (No. 21) The Administrative Measures for the Import and Export of Explosives for Civil Purposes, as deliberated and adopted at the 23rd executive meeting of the Ministry of Industry and Information Technology of the People's Republic of China on February 10, 2012 and approved by the Ministry of Public Security of the People's Republic of China and the General Administration of Customs of the People's Republic of China, are hereby issued, and shall come into force on September 1, 2012. Minister of Industry and Information Technology: Miao Wei Minister of Public Security: Meng Jianzhu Director of the General Administration of Customs: Yu Guangzhou March 19, 2012 Administrative Measures for the Import and Export of Explosives for Civil Purposes Article 1 To strengthen the administration of explosives for civil purposes, maintain the economic order of the state and protect public security, these Measures are made pursuant to the Regulation on the Safety Management of Explosives for Civil Purposes . Article 2 These Measures apply to the import and export of explosives for civil purposes. For the purpose of these Measures, the term “explosives for civil purposes” refers to various types of igniting and blasting materials such as gun powder, explosives and the products thereof, detonators and ignition fuses which are used for non-military purposes and listed in the directory of explosives for civil purposes. Article 3 The Ministry of Industry and Information Technology is in charge of the examination and approval of the import and export of explosives for civil purposes. The public security organs are in charge of the safety supervision and administration of the transportation of explosives for civil purposes inside China. Customs is in charge of the administration of the import and export of explosives for civil purposes. Article 4 To import and export explosives for civil purposes, examination and approval formalities shall be handled case by case pursuant to these Measures. It is strictly prohibited to import and export explosives for civil purposes without the Examination and Approval Form for the Import/Export of Explosives for Civil Purposes issued by the Ministry of Industry and Information Technology. Article 5 Enterprises with the Permit to Produce Explosives for Civil Purposes may apply to import raw materials (including semi-finished products) used in producing explosives for civil purposes, and may apply to export explosives for civil purposes (including semi-finished products) produced by them. Enterprises with the Permit to Sell Explosives for Civil Purposes may apply to import and export explosives for civil purposes within the scope of varieties approved under the Permit to Sell Explosives for Civil Purposes.
