Provisions on the Safety Management of Hazardous Chemical Transmission Pipelines

Chapter I General Provisions
Article 1 To strengthen the safety management of hazardous chemical transmission pipelines, prevent and reduce work safety accidents regarding hazardous chemical transmission pipelines, and protect the life and property safety of the people, these Provisions are formulated in accordance with the Work Safety Law of the People's Republic of China and the Regulation on the Safety Management of Hazardous Chemicals .
Article 2 These Provisions shall apply to the safety management of hazardous chemical transmission pipelines under the ground, on the surface or overhead and their ancillary facilities (hereinafter referred to as “hazardous chemical pipelines”) in public areas outside factories.
These Provisions shall not apply to the safety protection of crude oil, refined oil, natural gas, coal bed methane, and coal gas long-distance pipelines and the safety management of urban gas pipelines.
Article 3 An entity with the ownership or the right for the operational management of hazardous chemical pipelines (hereinafter referred to as the “pipeline entity”) shall, in accordance with the relevant laws and regulations on work safety and these Provisions, fulfill its responsibilities for work safety, formulate sound bylaws and operating procedures for the work safety of hazardous chemical pipelines and organize the implementation thereof, and accept the supervision and inspection conducted by the work safety administrative department pursuant to law.
Article 4 The work safety administrative departments at all levels shall be responsible for the supervision and inspection of work safety of hazardous chemical pipelines and shall examine the safety conditions of hazardous chemical pipeline construction projects pursuant to law.
Article 5 No entity or individual shall commit any conduct that endangers the work safety of hazardous chemical pipelines.
Every entity or individual shall be entitled to report conduct endangering the work safety of hazardous chemical pipelines to the work safety administrative department. The work safety administrative department which receives the report shall conduct handling pursuant to law.
Chapter II Planning of Hazardous Chemical Pipelines
Article 6 The construction of hazardous chemical pipelines shall follow the principles of safety first, economical land use as well as economy and rationality, and scientific plans shall be made in accordance with the relevant national standards, industrial standards and technical specifications.
Article 7 The chemical pipelines for phosgene, chlorine or any other highly toxic gas shall not pass through or cross any public area.
Strict control shall be exerted on the hazardous chemical pipelines for ammonia, hydrogen sulfide or any other toxic gas passing through or crossing any public area.
Article 8 The construction route of hazardous chemical pipelines to be selected shall stay away from seismic-active faults and areas likely to be hit by floods or geological disasters; and if unavoidable, reliable project handling measures shall be taken to ensure that the pipelines will not be affected by geological disasters.
The distance between hazardous chemical pipelines and public places such as residential communities, schools and buildings, structures, railways, highways, navigation channels, ports, municipal utilities, communication facilities, military facilities and electrical facilities shall comply with the provisions of the relevant laws, administrative regulations, national standards and industrial standards.
Chapter III Construction of Hazardous Chemical Pipelines
Article 9 A construction entity shall, in accordance with the relevant provisions of the State Administration of Work Safety on the safety supervision and administration of hazardous chemical construction projects, undergo formalities for examining safety conditions, examining the design of safety facilities, completion check of safety facilities for the new construction, reconstruction or expansion projects of hazardous chemical pipelines pursuant to law.
Article 10 A construction entity shall, in accordance with the provisions of the relevant laws and administrative regulations, entrust design entities with the corresponding qualifications to design the new construction, reconstruction or expansion projects of hazardous chemical pipelines.
Article 11 An entity undertaking the specific building of hazardous chemical pipelines shall have corresponding qualifications prescribed by the relevant laws and administrative regulations. The building entity shall undertake the specific building in accordance with the provisions of the relevant laws, regulations, national standards, industrial standards and technical specifications as well as the approved design for safety facilities, and be responsible for the project quality.
The personnel participating in the welding, anti-corrosion or nondestructive testing operations of hazardous chemical pipelines shall have the corresponding qualification certificates for conducting such operations.
Article 12 An entity responsible for supervising hazardous chemical pipeline projects shall supervise the overall construction quality of pipelines throughout the entire process and be responsible for the overall construction quality of hazardous chemical pipelines. A pipeline building entity shall, in strict accordance with the provisions of the relevant national standards and industrial standards, inspect the welding joints and anti-corrosion quality of pipelines, and conduct pressure tests and air tightness tests of pipelines in light of design requirements.
For a hazardous chemical pipeline laid in a river, lake or any other environmentally sensitive area, measures shall be taken to increase grade of the pipeline pressure design and increase protection tubes to ensure the safety of hazardous chemical pipelines.
Article 13 A pipeline entity shall, before putting hazardous chemical pipelines into trial production (use), conduct safety inspection of the relevant protection measures, make scientific plans for safe production (use), and produce or use pipelines in strict accordance with the plans.
Article 14 Where hazardous chemical pipelines have not been put into production (use) half a year after a pressure test, the pipeline entity shall conduct the air tightness test once again before putting such pipelines into production (use); for a hazardous chemical pipeline laid in a river, lake or any other environmentally sensitive area, the interval for conducting an air tightness test again shall be reduced accordingly.
Chapter IV Operation of Hazardous Chemical Pipelines
