Article 2 This Law shall apply to the statistical activities organized by the people's governments at all levels and the statistic institutions and relevant departments of the people's governments at or above the county level. The basic tasks of the statistical work are to make statistical investigations and analyses on economic and social development, provide statistical data and advisory opinions and conduct statistical supervisions. Article 3 The state shall set up a unified statistical system and practice a statistical management system of unified leadership and level-to-level responsibility. Article 4 The State Council, the local people's governments at all levels and the relevant departments thereof shall strengthen the organization and leadership of the statistical work so as to provide necessary guarantee for it. Article 5 The state shall strengthen scientific research in statistics, improve the scientific statistical indicator system and better the statistical investigation methods so as to make the statistical work more scientific. The state shall strengthen the computerization of statistical information in a planned way so as to promote the modernization of the technologies for collecting, processing, transmitting, sharing and storing statistical data and the statistical database system. Article 6 Statistic institutions and statistical personnel shall independently exercise their powers in statistical investigations, statistical reports and statistical supervisions, and no one may infringe upon such power. The local people's governments at all levels, the government statistic institutions, the relevant departments and the persons in charge of all these entities may not alter any of the statistical data collected or processed by statistic institutions and statistical personnel, or ask any statistic institution or statistical personnel or any other agency or personnel to falsify or alter statistical data by any way, or take revenge on statistical personnel who perform duties according to law or refuse or fight against statistical violations. Article 7 State organs, enterprises, public institutions, other organizations, individual industrial and commercial households, individuals and other statistical investigation objects must abide by this Law and the relevant state provisions and authentically, accurately, completely and timely provide the data needed by statistical investigation, and may not provide any unauthentic or incomplete statistical data or delay or refuse the report of statistical data. Article 8 The statistical work shall be subject to public supervision. Entities and individuals shall have the right to report statistical falsifications and other statistical violations. Entities and individuals that have performed meritorious services in reporting statistical violations shall be commended and rewarded. Article 9 Statistic agencies and statistical personnel shall keep confidential the national secrets, trade secrets and personal information they have access to in the process of doing the statistical work. Article 10 No entity or individual may use any false statistical data to get any honorary title, material gains or job promotion. Chapter II Statistical Investigation Management Article 11 Statistical investigation projects comprise national statistical investigation projects, departmental statistical investigation projects and local statistical investigation projects. “National statistical investigation projects” refers to the statistical investigation projects about the basic information of the whole nation. “Departmental statistical investigation projects” refers to the specialized statistical investigation projects of the relevant departments under the State Council. “Local statistical investigation projects” refers to the statistical investigation projects of the people's governments at or above the county level and the departments thereof. National statistical investigation projects, departmental statistical investigation projects and local statistical investigation projects shall be clearly defined and planned in an overall way so as to avoid repetition. Article 12 National statistical investigation projects shall be planned by the National Bureau of Statistics either by itself or collaboratively with the relevant departments under the State Council and be reported to the State Council for archival purposes. Key national statistical investigation projects shall be subject to the examination and approval of the State Council. Departmental statistical investigation projects shall be planned by the relevant departments under the State Council. Projects whose statistical investigation objects are within the jurisdiction of the relevant departments shall be reported to the National Bureau of Statistics for archival purposes. Projects whose statistical investigation objects are outside the jurisdiction of the relevant departments shall be subject to the examination and approval of the National Bureau of Statistics. Local statistical investigation projects shall be planned by the statistic institutions and the relevant departments of the local people's governments at or above the county level either independently or jointly. In particular, those planned by the statistic institutions of the people's governments at the provincial level either by themselves or jointly with the relevant departments shall be subject to the examination and approval of the National Bureau of Statistics; those planned by the statistic institutions of the people's governments below the provincial level either independently or jointly with the relevant departments shall be subject to the examination and approval of the statistic institutions of the people's governments at the provincial level; and those planned by the relevant departments of the local people's governments at or above the county level shall be subject to the examination and approval of the statistic institutions of the people's governments at the same level. Article 13 The examination and approval organs of statistical investigation projects shall examine the necessity, feasibility and scientific level of investigation projects. Where any investigation project meets the prescribed conditions, a written decision of approval shall be made and published. Where any investigation project fails to meet the prescribed conditions, a written decision of disapproval shall be made and an explanation shall be made. Article 14 When making a statistical investigation project, a statistical investigation system shall be made for the project and submitted for examination and approval or for archival purposes under Article 12 of this Law. A statistical investigation system shall stipulate the purpose, contents, methods, objects, organizational mode, investigation form, filing and publication of statistical data, etc. of the investigations. Statistical investigations shall be organized and implemented according to the statistical investigation system. Any change in the contents of the statistical investigation system shall be subject to the approval of the original examination and approval organ or filed with the original archive-filing organ.
