Chapter I General Provisions
Article 1 This Law is enacted for
the purposes of scientifically and effectively organizing statistical work,
guaranteeing the authenticity, accuracy, integrity, and timeliness of
statistical data, strengthening statistical supervision, leveraging the
important role of statistical work in understanding national conditions and
strength and serving high-quality economic and social development, and
promoting the development of China into a modern socialist country in all
respects.
Article 2 This Law shall apply to
the statistical activities organized by the people's governments at all levels
and the statistic institutions and relevant departments of the people's
governments at or above the county level.
The basic tasks of the statistical work are to make statistical investigations
and analyses on economic and social development, provide statistical data and
advisory opinions and conduct statistical supervisions.
Article 3 Statistical work upholds
the leadership of the Communist Party of China.
The state shall set up a unified statistical system and practice a statistical
management system of unified leadership and level-to-level responsibility.
Article 4 The State Council, the
local people's governments at all levels and the relevant departments thereof
shall strengthen the organization and leadership of the statistical work so as
to provide necessary guarantee for it.
Article 5 The state strengthens
scientific research in statistics, improves scientific and reasonable
statistical standards and the statistical indicator system in accordance with
new economic and social developments, includes new economic sectors and fields
in the scope of statistical investigation, and enhances statistical
investigation methods to make statistical work more scientific.
The state strengthens the development of statistical information technology in
a planned way and promotes the deep integration of modern information technology
and statistical work to facilitate the modernization of technologies for
collecting, processing, transmitting, sharing, and storing statistical data, as
well as the statistical database system.
Article 6 The state establishes a
complete, coordinated, efficient, binding, authoritative, and reliable
statistical supervision system.
Statistics institutions shall conduct statistical supervision on the
implementation of major national economic and social policies and measures and
the performance of statutory statistical duties by all regions and departments,
in accordance with the statistical investigation system and approved plans and
arrangements.
Article 7 Statistic institutions and
statistical personnel shall independently exercise their powers in statistical
investigations, statistical reports and statistical supervisions, and no one
may infringe upon such power.
No person who is in charge of a local people's government at any level, the
statistics institution or relevant department of a people's government at or
above the county level, or an entity, may modify any of the statistical data
collected or complied by a statistics institution or statistical personnel, or
require any statistics institution, statistical personnel, or any other
institution or personnel, to falsify or tamper with statistical data in any
manner, or expressly or impliedly require a subordinate entity and its
personnel or a respondent to a statistical investigation to submit false
statistical data, or retaliate against an entity or individual that performs
duties according to the law or refuses or resists statistical violations.
Article 8 State organs, enterprises,
public institutions, other organizations, individual industrial and commercial
households, individuals and other statistical investigation objects must abide
by this Law and the relevant state provisions and authentically, accurately,
completely and timely provide the data needed by statistical investigation, and
may not provide any unauthentic or incomplete statistical data or delay or
refuse the report of statistical data.
Article 9 Local people's governments
at all levels and the statistics institutions and relevant departments of
people's governments at or above the county level shall, in accordance with the
relevant provisions issued by the state, include the prevention and punishment
of statistical fraud or other fraud in the scope of responsibility for
law-based government administration and lawful performance of duties, establish
and improve a relevant responsibility system, strengthen the assessment and
management of the statistical work of leaders, and hold legally accountable
those who commit statistical fraud or other fraud.
Article 10 The statistical work shall
be subject to public supervision. Entities and individuals shall have the right
to report statistical falsifications and other statistical violations. Entities
and individuals that have performed meritorious services in reporting
statistical violations shall be commended and rewarded.
Article 11 Statistics institutions
and statistical personnel shall keep confidential the state secrets, work
secrets, trade secrets, personal privacy, and personal information that come to
their knowledge during statistical work, and shall not divulge them or
illegally provide them to another person.
Article 12 No entity or individual
may use any false statistical data to get any honorary title, material gains or
promotion in position or rank, among others.
Chapter II Statistical Investigation Management
Article 13 Statistical investigation
projects comprise national statistical investigation projects, departmental
statistical investigation projects and local statistical investigation
projects.
“National statistical investigation projects” refers to the statistical
investigation projects about the basic information of the whole nation.
“Departmental statistical investigation projects” refers to the specialized
statistical investigation projects of the relevant departments under the State
Council. “Local statistical investigation projects” refers to the statistical
investigation projects of the people's governments at or above the county level
and the departments thereof.
National statistical investigation projects, departmental statistical
investigation projects and local statistical investigation projects shall be
clearly defined and planned in an overall way so as to avoid repetition.
Article 14 National statistical
investigation projects shall be planned by the National Bureau of Statistics
either by itself or collaboratively with the relevant departments under the
State Council and be reported to the State Council for archival purposes. Key
national statistical investigation projects shall be subject to the examination
and approval of the State Council.
Departmental statistical investigation projects shall be planned by the
relevant departments under the State Council. Projects whose statistical
investigation objects are within the jurisdiction of the relevant departments
shall be reported to the National Bureau of Statistics for archival purposes.
Projects whose statistical investigation objects are outside the jurisdiction
of the relevant departments shall be subject to the examination and approval of
the National Bureau of Statistics.
Local statistical investigation projects shall be planned by the statistic
institutions and the relevant departments of the local people's governments at
or above the county level either independently or jointly. In particular, those
planned by the statistic institutions of the people's governments at the
provincial level either by themselves or jointly with the relevant departments
shall be subject to the examination and approval of the National Bureau of
Statistics; those planned by the statistic institutions of the people's
governments below the provincial level either independently or jointly with the
relevant departments shall be subject to the examination and approval of the
statistic institutions of the people's governments at the provincial level; and
those planned by the relevant departments of the local people's governments at
or above the county level shall be subject to the examination and approval of
the statistic institutions of the people's governments at the same level.
Article 15 The examination and
approval organs of statistical investigation projects shall examine the
necessity, feasibility and scientific level of investigation projects. Where
any investigation project meets the prescribed conditions, a written decision
of approval shall be made and published. Where any investigation project fails
to meet the prescribed conditions, a written decision of disapproval shall be
made and an explanation shall be made.
Article 16 When making a statistical
investigation project, a statistical investigation system shall be made for the
project and submitted for examination and approval or for archival purposes
under Article 14 of this Law.
