Measures for the Public Security Administration of the Scrap Metal Collection Industry (2023 Revision)
(As approved by the State Council on January 5, 1994, issued by Order No. 16 of the Ministry of Public Security on January 25, 1994, and revised in accordance with the Decision of the State Council to Amend and Repeal Certain Administrative Regulations on July 20, 2023)
Article 1 These Measures are developed for the purpose of strengthening the public security administration of the scrap metal collection industry, protecting lawful business operations, and preventing and cracking down on illegal and criminal activities.
Article 2 For the purposes of these Measures, “scrap metals” means productive scrap metals and non-productive scrap metals. The specific classification of productive scrap metals and non-productive scrap metals shall be provided for by the Ministry of Public Security in conjunction with the relevant departments.
Article 3 Productive scrap metals shall, in accordance with the applicable provisions issued by the State Council, be collected by enterprises having the right to conduct business operations in the productive scrap metal collection industry. Other enterprises and individual industrial and commercial households collecting scrap metals may only collect non-productive scrap metals, and may not collect productive scrap metals.
Article 4 An enterprise or an individual industrial and commercial household collecting scrap metals shall, within 15 days of obtaining its business license, undergo recordation formalities with the public security authority of the people's government of the county or equivalent where it is located.
If any recordation matter changes, the enterprise or individual industrial and commercial household collecting scrap metals shall, within 15 days of the change (or within 15 days of modification of industrial and commercial registration if it is a matter of industrial and commercial registration), undergo modification formalities with the public security authority of the people's government of the county or equivalent.
The public security authorities may, by online and other means, facilitate the recordation of enterprises and individual industrial and commercial households.
