Regulations on the Administration of Slaughtering of Pigs (2016 Revision) Regulations on the Administration of Slaughtering of Pigs (Promulgated by Order No. 238 of the State Council of the People's Republic of China on December 19, 1997; revised and adopted at the 201st executive meeting of the State Council on December 19, 2007; revised in accordance with the Decision of the State Council on Appealing and Amending Some Administrative Regulations on January 8, 2011 for the first time; and revised in accordance with the Decision of the State Council on Amending Some Administrative Regulations on February 6, 2016 for the second time) Chapter I General Provisions Article 1 These Regulations are formulated for the purpose of strengthening administration of hog slaughter, ensuring the quality safety of hog products and safeguarding people's health. Article 2 The State implements a system whereby hogs are slaughtered by designated hog slaughter plants (houses) and quarantined in a centralized manner. Any unit or individual not being designated may not engage in hog slaughter except that individuals in rural areas may slaughter hogs for their own consumption. In outlying or inaccessible rural areas, small-scale hog slaughter houses (sites) that supply hog products only to local markets may be set up. The specific measures for administration thereof shall be formulated by the provinces, autonomous regions or municipalities directly under the Central Government. Article 3 The competent administrative department of animal husbandry and veterinary of the State Council is responsible for administration of the hog slaughter industry nationwide. The competent administrative department of animal husbandry and veterinarys of the local people's governments at or above the county level are responsible for supervision and administration of hog slaughter within their respective administrative areas. The relevant departments of the people's governments at or above the county level are, within their respective functions and duties, responsible for administration related to hog slaughter. Article 4 The State shall, on the basis of the scales and production and technological conditions of the designated hog slaughter plants (houses) , and the levels of their quality safety management, apply a grading system for administration of the designated hog slaughter plants (houses) , with a view to encouraging, guiding and supporting designated hog slaughter plants (houses) to improve their production and technological conditions, enhance management in respect of product quality safety and raise the quality safety standards of hog products. The specific measures for grading of the designated hog slaughter plants (houses) shall be developed by the competent administrative department of animal husbandry and veterinary of the State Council. Chapter II Hog Slaughter by Designated Plants (Houses) Article 5 The plans for establishment of designated hog slaughter plants (houses) (hereinafter referred to as establishment plans) shall be formulated by the competent administrative department of animal husbandry and veterinary of the people's government of a province, autonomous region, or municipality directly under the Central Government in conjunction with the competent environmental protection department and other relevant departments, the environmental protection departments and other relevant departments, in adherence to the principles of rational geographical distribution, proper centralization, good circulation and convenience to the public and in light of the actual local conditions, and the plans shall be submitted to the said people's governments for approval before being implemented. Article 6 The people's government at the level of a districted city shall, on the basis of the establishment plan, organize the competent administrative department of animal husbandry and veterinary, the competent environmental protection department, and other relevant departments to examine whether the pig slaughter plants (houses) to be designated satisfy the conditions specified in the Regulation, make a decision after consulting the competent administrative department of animal husbandry and veterinary of the people's government of the province, autonomous region, or municipality directly under the Central Government, and issue the certificates and plaques of designated pig slaughter plants (houses) to them. The people's government at the level of a city divided into districts shall, in a timely manner, publish the list of the hog slaughter plants (houses) that it has decided to designate, and submit the list for the record to the people's government of the province, autonomous region or municipality directly under the Central Government. Article 7 A designated hog slaughter plant (house) shall hang its signboard of a, designated hog slaughter plant (house) at a conspicuous place of the plant (house). The permits or signboards of designated hog slaughter plants (houses) shall not be lent or transferred. No unit or individual may fraudulently use the permit or signboard of a designated hog slaughter plant (house) or use a forged one. Article 8 A designated hog slaughter plant .(house) shall meet the following conditions: (1) having a source of water supply that is commensurate with the scale of slaughter and meets the standards set by the State for water quality; (2) having stand-by slaughter rooms, slaughter rooms, emergency slaughter rooms, hog slaughter equipment and means of transport which conform to the requirements prescribed by the State; (3) having the technical staff for hog slaughter who have obtained health certificates in accordance with law; (4) having inspectors of meat product quality who have been qualified through assessment; (5) having inspection equipment and sterilization facilities that conform to the requirements prescribed by the State, and the facilities for pollution prevention and control that conform to the requirements for environmental protection; (6) having the facilities for innocuous disposal of diseased hogs and such hog products; and (7) having obtained the qualification certificate of animal epidemic prevention in accordance with law. Article 9 The quarantine of hog slaughter and the supervision thereof shall be conducted in accordance with the Law on Animal Epidemic Prevention and the relevant provisions of the State Council. The hygienic inspection of hog slaughter and the supervision thereof shall be conducted in accordance with the Food Safety Law . Article 10 Hogs to be slaughtered at a designated hog slaughter plant (house) shall, in accordance with law, pass the quarantine conducted by the animal health supervision institution and have quarantine certificates attached to them.
