Measures for the Supervision and Administration of Power Work Safety Order of the National Development and Reform Commission (Order No. 21) The Measures for the Supervision and Administration of Power Work Safety,as deliberated and adopted at the Director's Executive Meeting of the National Development and Reform Commission, are hereby issued and shall come into force on March 1, 2015. Director: Xu Shaoshi February 17, 2015 Measures for the Supervision and Administration of Power Work Safety Chapter I General Provisions Article 1 In order to effectively conduct supervision and administration of power work safety, prevent and reduceelectric poweraccidents, and guarantee the safe and stable operation of the electric power system and the reliable supply of electric power, these Measures are formulated in accordance with the Work Safety Law of the People's Republic of China , the Emergency Response Law of the People's Republic of China , the Regulation on Electric Power Supervision , the Regulation on the Report, Investigation and Handling of Work Safety Accidents , the Regulation on the Emergency Response to and Investigation and Handling of Electric Power Safety Accidents and other laws and regulations. Article 2 These Measures shall apply to the electric power enterprises that take electricity generation, transmission and supply and electric power construction as their main business and have obtained relevant business licenses or are exempt from power business licenses under the relevant provisions within the territory of the People's Republic of China. Article 3 The National Energy Administration (“NEA”) and its dispatched offices shall, in accordance with these Measures, conduct supervision and administration of electric power enterprises' electric power operation safety (excluding nuclear safety), electric power construction safety, electric power project quality safety, electric power emergency, hydropower station dam operation safety,electric power reliability, etc. Article 4 In the work of power work safety, the principle of “safety first, focus on prevention, and integrated control” shall be adhered to, and a working mechanism including the responsibilities of electric power enterprises, governmental regulation, industry self-regulation and social supervision shall be established. Article 5 As the subject of responsibility for power work safety, an electric power enterprise shall, in accordance with the laws, regulations, rules and standards of the state on work safety, establish and improve the powerwork safety responsibility system, strengthen the administration of power work safety, and improve the conditions for power work safety, so as to ensure power work safety. Article 6 All entities and individuals shall be entitled to lodge complaints or file reports against the violations of these Measures and the provisions of the state on the supervision and administration of power work safety to the NEA and its dispatched offices, and the NEA and its dispatched offices shall handle such violations in accordance with the law. Chapter II Work Safety Responsibility of Electric Power Enterprises Article 7 The primary persons-in-charge of electric power enterprises shall take full responsibility for the work safety work of their respective entities. Employees of electric power enterprises shall fulfill their obligations regarding work safety in accordance with the law. Article 8 Electric power enterprises shall perform the following basicresponsibilities in the administration of power work safety: (1) Developing and implementing the rules on and the procedures for the administration of power work safety of these entities in accordance with the laws, regulations, rules and standards of the state on work safety. (2) Establishing and improving the assurance system and supervision system for power work safety, and implementing the work safety responsibilities. (3) Establishing work safety management institutions or hiring full-time work safety management personnel in accordance with the relevant laws and regulations of the state. (4) Setting aside and using as prescribed power work safety funds for the exclusive purpose of improving work safety conditions. (5) Establishing and improving the rules on the screening, elimination and governance of hidden power work safety hazards and the risk pre-control system in accordance with the relevant provisions, conducting the screening and elimination of hidden risks and risk identification, evaluation and supervision and control, and governing, administering and controlling potential safety hazards and risks. (6) Conducting the standardization construction of power work safety. (7) Conducting the power work safety training, publicity and education, and taking charge of the safety training of employees, especially group leaders, new workers and migrant workers. (8) Conducting the electric power reliability management, establishing and improving the electric power reliability management system, and submitting electric power reliability information in an accurate, timely and complete manner. (9) Establishing the electric power emergency management system, improving the coordination and joint operation mechanisms, developing various kinds of emergency response plans at all levels and conducting emergency drills, building emergency rescue teams, and improving emergency material reserve system. (10) Reporting the information on electric power accidents and electric power safety incidents as prescribed, and conducting an emergency response in a timely manner, and investigating and handling electric power safety incidents. Article 9 Electricity generation enterprises shall conduct thesafety registration of dams of hydropower plants, and conduct regular inspections on the safety of dams and the information technology construction; and shall conduct the recordation of the safety of ash storage yards of coal-fired power plants, and conduct safety patrol inspections and periodic safety assessment.
