The Interim Administrative Measures for the Recognition of Cultural Relics, which were deliberated and adopted at the executive meeting of the Ministry of Culture on August 5, 2009, are hereby promulgated, and shall come into force on October 1, 2009.

Interim Administrative Measures for the Recognition of Cultural Relics
(Promulgated by Order No.46 of the Ministry of Culture on August 10, 2009 and coming into force on October 1, 2009)
Article 1 To regulate the administration of recognition of cultural relics, these Measures are formulated pursuant to the Cultural Relics Protection Law of the People's Republic of China .
The term “recognition of cultural relics” as mentioned in these Measures refers to the administrative act of determining certain cultural resources with a historical, artistic or scientific value as cultural relics by the administrative department of cultural relics.
Article 2 The items listed in paragraph 1 of Article 2 of the Cultural Relics Protection Law of the People's Republic of China shall be recognized as cultural relics.
Cultural relics of a special type, such as vernacular architecture, industrial heritage, agricultural heritage, time-honored trade name, cultural route and cultural landscape, shall be recognized according to these Measures.
Article 3 The local administrative department of cultural relics at or above the county level shall be responsible for the recognition of cultural relics. Disputes over recognized cultural relics shall be referred to the administrative department of cultural relics at the provincial level for a ruling.
The administrative department of cultural relics at the provincial level shall recognize particular cultural resources as cultural relics according to the requirements of the administrative department of cultural relics under the State Council.
Article 4 The administrative department of cultural relics under the State Council shall issue guiding opinions on a regular basis to clarify the scope and focus of work on the recognition of cultural relics.
Article 5 The administrative department of cultural relics at each level shall conduct general surveys on cultural relics on a regular basis, and the cultural relics unearthed in the survey shall be recognized by the loca......
