Administrative Measures for the Entry-Exit Examination and Verification of Cultural Relics Order the Minister of Culture (No.42) Administrative Measures for the Entry-Exit Examination and Verification of Cultural Relics,which was deliberated and adopted at the utive meeting of the Ministry of Culture on July 3rd,2007,is hereby promulgated on July 4th. The Minister of Culture:Sun Jiazheng July 13th, 2007 Administrative Measures for the Entry-Exit Examination and Verification of Cultural Relics Article 1 For the purpose of strengthening the administration of the entry-exit examination and verification of cultural relics, these Measures are formulated in accordance with the Cultural Relics Protection Law of the People's Republic of China and the Regulation for the Implementation of the Cultural Relics Protection Law of the People's Republic of China . Article 2 The State Administration of Cultural Heritage shall take charge of the administrative work of the entry-exit examination and verification of cultural relics and appoint institutions to undertake the work of entry-exit examination and verification of cultural relics. An institution responsible for the entry-exit examination and verification of cultural relics is an administrative law enforcement organ of cultural relics, which independently exercises its functions and powers according to law, reports its work to the State Administration of Cultural Heritage and is subject to the business guidance provided by the State Administration of Cultural Heritage. Article 3 An institution responsible for the entry-exit examination and verification of cultural relics shall be jointly established by the State Administration of Cultural Heritage and the provincial people's government. The provincial people's government shall guarantee the authorized size, work place and operating expenses of the institution, while the State Administration of Cultural Heritage shall subsidize the business expenses of the institution. Article 4 An institution responsible for the entry-exit examination and verification of cultural relics shall: 1. have 7 or more full-time appraisers of cultural relics, among whom, there shall be at least 5 responsible appraisers for the entry and exit of cultural relics; 2. have a fixed work place and necessary technical equipments; and 3. incorporate all the operating expenses into its financial budget. Article 5 The State Administration of Cultural Heritage shall, in light of the actual demands of the entry-exit examination and verification of cultural relics, appoint qualified institutions responsible for the entry-exit examination and verification of cultural relics to undertake the entry-exit examination and verification work of cultural relics, use the mark for the exit of cultural relics and the mark for the temporary entry of cultural relics and issue exit permits to verified cultural relics. Article 6 Employees of institutions responsible for the entry-exit examination and verification of cultural relics shall have corresponding post-holding certificates, and may not hold any concurrent job or part-time job at any cultural relics store or auction enterprise. The principal in charge of an institution responsible for the entry-exit examination and verification of cultural relics shall have the certificate of competence issued by the State Administration of Cultural Heritage.
