Provisions on Offshore Oil Work Safety (2015 Revision) Provisions on Offshore Oil Work Safety (Issued by the Order No. 4 of the State Administration of Work Safety on February 7, 2006, amended for the first time in accordance with the Order No. 63 of the State Administration of Work Safety on August 29, 2013 and amended for the second time in accordance with the Order No. 78 of the State Administration of Work Safety on May 29, 2015) Chapter 1 General Provisions Article 1 These Provisions are formulated in accordance with the Law of the People's Republic of China on Work Safety and relevant laws and administrative regulations to strengthen offshore oil work safety, prevent and reduce offshore oil work safety accidents and occupational hazards, and ensure the life and property safety for practitioners. Article 2 These Provisions apply to work safety in exploitation activities carried out in the internal waters, territorial seas, contiguous zones, exclusive economic zones, continental shelves of the People's Republic of China and other sea areas under the jurisdiction of the People's Republic of China. Article 3 The operator and contractor of offshore oil activities are the responsibility subjects for offshore work safety. For the purpose of these Provisions, the operator means the enterprise responsible for the implementation of offshore oil exploitation, or the entity that is responsible for the implementation of offshore oil exploitation as agreed in the oil contract. For the purpose of these Provisions, the contractor means the enterprise or entity that provides services for the operator. Article 4 The State Administration of Work Safety (hereinafter referred to as "SAWS") conducts comprehensive supervision and administration over offshore oil work safety. The SAWS has an offshore oil work safety office (hereinafter referred to as "Office"), which serves as the executive body for comprehensive supervision and administration over offshore oil work safety. The Office may set up branches if necessary and the branches so established shall conduct work safety supervision and administration according to relevant provisions. Chapter 2 Work Safety Assurance Article 5 The operator and contractor shall abide by the laws, administrative regulations, departmental rules, national standards and industry standards relating to work safety, and shall meet work safety requirements. Article 6 The operator shall strengthen the safety supervision and administration over the contractor, and stipulate in the contract their respective responsibilities for work safety management. Article 7 The main responsible persons of the operator and contractor shall be comprehensively responsible for each entity's work safety. The operator and contractors undertaking geophysical exploration, drilling, well logging, data keeping, well testing, underground operations, the main responsible persons of the offshore oil production facilities, and the safety management personnel may only hold their posts after they have received safety qualification trainings, had required work safety knowledge and management abilities and obtained certificates through examinations, according to the provisions of the SAWS. Article 8 The operator and contractor shall provide works safety education and training for their practitioners to ensure the practitioners have necessary work safety knowledge, be familiar with relevant work safety rules and regulations and operational rules and master safety operation skills for their respective posts. Article 9 Offshore workers shall receive offshore oil work safety and rescue training and may only work offshore after passing the examination. Contingent offshore workers shall receive necessary safety education. Article 10 Special operation workers shall receive special safety technology training required by the SAWS, and may hold their posts after obtaining the qualification certificates for special operations through examination. Article 11 Preliminary safety assessment shall be conducted at the feasibility study stage or when the general development scheme is being drafted for an offshore oil construction project. The preliminary safety assessment report shall be reviewed and submitted to the Office for record-filing. In the design stage, critical design documents and safety documents regarding offshore oil production facilities shall be examined and approved by the certificate issuing and inspecting body for the facilities (hereinafter referred to as the “Certificate Issuing and Inspecting Body”). The Certificate Issuing and Inspecting Body shall stamp the design documents and drawings it has examined and approved. Article 12 An offshore oil production facility shall be constructed by professional entities with relevant qualifications or capabilities. Such entities shall construct according to the design schemes or drawings duly examined and approved. Article 13 Before an offshore oil production facility is put into trial production, a final inspection certificate or interim inspection certificate shall be obtained from the Certificate issuing and Inspecting Body, safety measures shall be developed for the trial production and submitted to relevant branch of the Office 45 days before the trial production for record-filing. The relevant branch of the Office shall inspect the status of the offshore oil production facility and the implementation of the safety measures. Article 14 Where the trial production of the facility is successful, an application shall be submitted to the Office for completion inspection and acceptance. The facility may be put into use after it is accepted and a license for work safety is issued. Article 15 The operator and contractor shall inform the workers of the risk factors and occupational hazard factors existing in the work sites and their posts in a faithful manner, and get them acquainted with corresponding preventive and emergency measures. Article 16 The operator and contractor shall provide protective articles that meet national standards or industry standards, and supervise and instruct the workers to wear and use them according to relevant use rules.
