Administrative Measures for Work Safety Training (2015Amendment) Administrative Measures for Work Safety Training (Issued by the Order No. 44 of the State Administration of Work Safety on January 19, 2012, amended for the first time in accordance with the Order No. 63 of the State Administration of Work Safety on August 29, 2013 and amended for the second time in accordance with the Order No. 80 of the State Administration of Work Safety on May 29, 2015) Chapter I General Provisions Article 1 To strengthen the administration of work safety training, regulate the order in work safety training, ensure the quality of work safety training, and promote the sound development of work safety training, these Measures are formulated in accordance with the Work Safety Law of the People's Republic of China and other relevant laws and administrative regulations. Article 2 These Measures shall apply to the work safety training activities (hereinafter referred to as “safety training”) of safety training agencies and production and operation entities and the safety training supervision and administration by work safety administrative departments, coal mine safety supervisory authorities, and coal mine safety training departments of local people's governments. Article 3 For the purposes of these Measures, “safety training” means the educational and training activities that aim to improve the safety quality of safety regulation and supervision personnel, employees of entities engaged in production and other operations, and personnel working in relation to work safety. The “safety regulation and supervision personnel” as mentioned in the preceding paragraph means the work safety regulators and coal mine safety supervisors engaged in safety regulation, supervision and law enforcement of the work safety administrative departments of the people's governments at and above the county level and the coal mine safety supervisory authorities at all levels. The “employees of entities engaged in production and other operations” means the primary persons in charge, work safety management personnel, special operations personnel, and other employees of entities engaged in production and other operations. The “personnel working in relation to work safety” means the teachers engaged in safety education and training, registration staff of hazardous chemical registration institutions, persons engaged in safety evaluation, consulting, testing and inspection, certified safety engineers, and work safety emergency personnel, among others. Article 4 The principle of “unified planning, centralized management, implementation by level, categorized guidance, and separation of teaching from examinations” shall be followed in safety training work. The State Administration of Work Safety (“SAWS”) shall guide the national safety training work and conduct supervision an administration of safety training across the country in accordance with law. The State Administration of Coal Mine Safety (“SACMS”) shall guide the national coal mine safety training work and conduct supervision and administration of coal mine safety training across the country in accordance with law. The National Workplace Emergency Management Center shall guide the national training on work safety emergency rescue. The work safety administrative departments of the local people's governments at and above the county level shall conduct supervision and administration of safety training within their respective administrative regions. The coal mine safety training departments of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government and the coal mine safety supervisory authorities at the provincial level (hereinafter collectively referred to as “provincial coal mine safety training regulatory authorities”) shall, within their respective functions, conduct supervision and administration of coal mine safety training within their respective jurisdictions. Article 5 A safety training agency shall have the conditions required for engaging in safety training. The safety training agencies, which are responsible for the training of main persons in charge of entities engaged in the production, operation and storage of dangerous goods as well as mines, and metal smelters, work safety management personnel, special operations personnel, certified safety engineers, and other related personnel, shall report in writing the information about teachers, teaching and facilities for internship and practical training to the local work safety administrative departments and the regulatory authorities of coal mine safety training. Social organizations related to work safety shall, in accordance with the laws, administrative regulations, and bylaws, provide services relevant to safety training to production and operation entities, conduct self-disciplinary administration on safety training agencies, and promote the enhancement of the level of safety training. Chapter II Safety Training Article 6 Safety training shall be conducted in accordance with the prescribed safety training syllabus. The safety training syllabus for safety regulators and supervisors, the main persons in charge, work safety management personnel and special operations workers of entities producing, operating or storing dangerous goods, as well as non-coal mines, and metal smelters, and the persons working in relation to work safety shall be formulated under the organization of the State Administration of Work Safety. The safety training syllabus for the primary persons in charge, work safety management personnel and special operations workers of coal mine enterprises shall be formulated under the organization of the State Administration of Coal Mine Safety. The safety training syllabus for the main persons in charge, work safety management personnel and other employees of entities engaged in production and operations other than entities producing, operating and storing dangerous goods, as well as mine enterprises and metal smelters, shall be formulated under the organization of the provincial work safety administrative departments and provincial coal mine safety training regulatory authorities. Article 7 The SAWS and provincial work safety administrative departments shall regularly organize review and recommendation of top teaching materials for safety training. Safety training agencies shall give priority to the use of such top teaching materials for safety training. Article 8 The State Administration of Work Safety shall be responsible for the training of the work safety regulators of the work safety administrative departments at and above the provincial level and the coal mine safety supervisors of the coal mine safety supervisory authorities at all levels. The provincial work safety administrative departments shall be responsible for the training of the work safety regulators of the work safety administrative departments at the city level and at the county level. A production and operation entity shall be responsible for the safety training for its practitioners. The safety training for the registration staff of hazardous chemical registration institutions, the persons engaged in safety evaluation, consulting, testing and inspection, the certified safety engineers, and the work safety emergency rescue personnel shall be conducted in accordance with relevant laws, regulations and rules.
