Measures for the Administration of Registration of Hazardous Chemicals (2012) Order of the State Administration of Work Safety (No. 53) The Measures for the Administration of Registration of Hazardous Chemicals, as deliberated and adopted at the Director's Executive Meeting of the State Administration of Work Safety on May 21, 2012, are hereby issued, and shall come into force on August 1, 2012. The Measures for the Administration of Registration of Hazardous Chemicals issued by the former State Economic and Trade Commission on October 8, 2002 shall be repealed simultaneously. Director of the State Administration of Work Safety: Yang Dongliang July 1, 2012 Measures for the Administration of Registration of Hazardous Chemicals Chapter I General Provisions Article 1 In order to strengthen the safety administration of hazardous chemicals, regulate the registration of hazardous chemicals, and provide technological and information support to the prevention and emergency rescue of hazardous chemical accidents, these Measures are formulated in accordance with the Regulation on the Safety Administration of Hazardous Chemicals . Article 2 These Measures shall apply to the registration and administration of hazardous chemicals listed in the Catalogue of Hazardous Chemicals produced by hazardous chemical producers or imported by hazardous chemical importers (hereinafter referred to as “registration enterprises” jointly). Article 3 The state shall apply a hazardous chemical registration system. The principles of “application by enterprises, two-level examination, uniform certificate issuance and level-to-level administration” shall apply to the registration of hazardous chemicals. Article 4 The State Administration of Work Safety shall be responsible for the supervision over and administration of the registration of hazardous chemicals nationwide. The work safety administrative departments of local people's governments at or above the county level shall be responsible for the supervision over and administration of the registration of hazardous chemicals within their respective administrative regions. Chapter II Registration Authorities Article 5 The Chemical Registration Center of the State Administration of Work Safety (hereinafter referred to as the “Registration Center”) shall undertake the specific work and technological management of the registration of hazardous chemicals nationwide. The work safety administrative departments of people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall establish hazardous chemical registration offices or hazardous chemical registration centers (hereinafter referred to as “registration offices”) to undertake the specific work and technological management of the registration of hazardous chemicals within their respective administrative regions. Article 6 The Registration Center shall perform the following duties: 1. organize, coordinate and guide the registration of hazardous chemicals nationwide; 2. be responsible for the examination of registration content of hazardous chemicals nationwide, as well as the issuance and administration of hazardous chemical registration certificates; 3. be responsible for managing and maintaining the national information management system for hazardous chemical registration (hereinafter referred to as the “registration system”) and the dynamic statistics and analysis of hazardous chemical registration information; 4. be responsible for managing and maintaining the national emergency response consulting hotline for hazardous chemical accidents and providing 24-hour emergency response consulting services; 5. organize the assessment of hazard of chemicals and uniformly classify the hazard of unclassified chemicals; 6. offer business guidance to registration offices and be responsible for providing training for the registration staff of hazardous chemicals of registration offices nationwide; and 7. submit periodical reports on the registration of hazardous chemicals to the relevant department of the State Council and make announcements to the public. Article 7 Registration offices shall perform the following duties: 1. organize the registration of hazardous chemicals within their respective administrative regions; 2. examine the conformity and consistency of the application materials of registration enterprises; 3. be responsible for the statistics and analysis of hazardous chemical registration information within their respective administrative regions; 4. provide information support to the prevention and emergency rescue of hazardous chemical accidents; and 5. assist work safety administrative departments within their respective administrative regions in providing registration training and direct registration enterprises' registration of hazardous chemicals. Article 8 The staff members of the Registration Center and registration offices (hereinafter referred to as “registration authorities”) who engage in the registration of hazardous chemicals (hereinafter referred to “registration staff members”) shall have the educational background of junior college or above in the corresponding specialties such as chemical engineering, chemistry and safety engineering, receive uniform business training, and take positions only after they pass the training. Article 9 Registration offices shall meet the following conditions: 1. have three or more registration staff members; 2. have strict responsibility rules, confidentiality rules, file management rules and database maintenance rules; and 3. have necessary office equipment and facilities. Chapter III Registration Time, Content and Procedures Article 10 A newly established production enterprise shall undergo the formalities for the registration of hazardous chemicals before the check and acceptance of completed projects. An import enterprise shall undergo the formalities for the registration of hazardous chemicals before the hazardous chemicals are imported for the first time. Article 11 Where a same enterprise produces or imports a same variety of hazardous chemicals, it shall register the hazardous chemicals of the production enterprise once, but shall submit the information on the imported hazardous chemicals. Where an import enterprise imports a same variety of hazardous chemicals produced by different manufacturers, it shall register the hazardous chemicals of manufacturers imported for the first time once, but shall submit the information on hazardous chemicals of other manufacturers. Where a production enterprise or import enterprise imports a same variety of hazardous chemicals of the same manufacturer for many times, it shall register the hazardous chemicals once. Article 12 The following information on hazardous chemicals shall be registered: 1. classification and labels, including the hazard categories, pictogram, caution words, hazard statements and precaution statements of hazardous chemicals; 2. physical and chemical properties, including the appearance, traits, solubility, melting point, boiling point and other physical properties, as well as flash point, explosive limit, auto-ignition temperature, decomposition temperature and other chemical properties of hazardous chemicals; 3. main uses, including the legal uses, and prohibited or restricted uses of products recommended by enterprises; 4. hazardous properties, including the physical danger, env......
