Interim Measures for the Protection of the Lawful Rights and Interests of the Chairmen of Trade Unions of Enterprises

Chapter I General Provisions
Article 1 For purposes of protecting the rights actively and in a scientific way and according to law, protecting the lawful rights and interests of chairmen of trade unions of enterprises, ensuring their fulfillment of duties according to law and giving play to the role of trade unions of enterprises in the development of enterprises and protection of the rights and interests of employees, these Measures are formulated in accordance with the Trade Union Law , Labor Law , Employment Contract Law and other laws and regulations.
Article 2 These Measures shall apply to the protection of the lawful rights and interests of the full time and part time chairmen and deputy chairmen of various enterprises within the territory of the People's Republic of China.
The lawful rights and interests of the chairmen of trade unions of public enterprises managed as enterprises, chairmen of trade unions of private non-enterprise entities, and chairmen of associations of regional and industrial trade unions and associations of grass-root trade unions shall be protected by analogy to these Measures.
Article 3 The trade unions at all levels shall protect the lawful rights and interests of the chairmen of trade unions of enterprises in pursuance of the relevant laws, regulations and policies of the state and in strict accordance with the provisions and organization procedures of the Constitution of All-China Federation of Trade Unions.
Chapter II Protection Contents and Measures
Article 4 Where the chairman of the trade union of an enterprise, due to fulfillment of his duties according to law, is demoted, is suspended from his duties or salaries, has his wage lowered or has his other fringe interests detained, or is framed and wrongly handled or transferred to another position by the enterprise, suffers retaliation and can not resume his former job and enjoy the interests for the former position, or has not been assigned to a proper position, the trade union at the higher level should, jointly with the Party organization of the enterprise, urge the enterprise to revoke the decision on handling him, resume his position of chairman of the trade union and fully compensate for his economic losses.
