The Frontier Health and Quarantine Law of the People's Republic of China, as revised and adopted at the 10th Session of the Standing Committee of the Fourteenth National People's Congress of the People's Republic of China on June 28, 2024, is hereby issued, and shall come into force on January 1, 2025.

Frontier Health and Quarantine Law of the People's Republic of China

Chapter I General Provisions
Article 1 This Law is enacted in accordance with the Constitution for the purposes of strengthening efforts in frontier health and quarantine, preventing the cross-border transmission of infectious diseases, protecting the life safety and health of the public, and preventing and addressing public health risks.
Article 2 This Law applies to frontier health and quarantine and related activities.
At the ports of the People's Republic of China open to the outside world ("ports"), the Customs shall perform frontier health and quarantine duties such as quarantine inspection, infectious disease monitoring, health supervision, and emergency response in accordance with this Law.
Article 3 For the purposes of this Law, "infectious disease" includes a quarantinable infectious disease, a monitored infectious disease, or any other emerging infectious disease or sudden infectious disease of unknown cause that requires the adoption of corresponding health and quarantine measures at ports.
The disease prevention and control authority of the State Council shall, in conjunction with the General Administration of Customs, compile, adjust, and publish with the approval of the State Council a list of quarantinable infectious diseases. The disease prevention and control authority of the State Council shall, in conjunction with the General Administration of Customs, compile, adjust, and publish a list of monitored infectious diseases.
The list of quarantinable infectious diseases and the list of monitored infectious diseases shall be adjusted promptly according to the outbreak, prevalence, and degree of harm of infectious diseases at home and abroad.
Article 4 Frontier health and quarantine shall adhere to the leadership of the Communist Party of China, follow the principles of risk management, scientific policy implementation, and efficient actions, and improve the infectious disease prevention and control system for ports that combines regular functions with emergency response.
Article 5 The GACC shall uniformly administer national frontier health and quarantine. The health authority, disease prevention and control authority, and other authorities of the State Council shall effectively carry out the work related to frontier health and quarantine in accordance with their respective duties.
The local people's government at or above the county level in the place where a port is located shall incorporate the work relating to frontier health and quarantine into its infectious disease prevention and control plan, and increase support for frontier health and quarantine.
Customs, health, disease prevention and control, and other relevant authorities shall cooperate closely in frontier health and quarantine by establishing a departmental coordination mechanism and strengthening information sharing, coordination, and interaction.
The state strengthens border control measures in accordance with the law to strictly prevent the risk of introducing an infectious disease created by illegal entry.
Article 6 When the Customs perform their frontier health and quarantine duties in accordance with the law, the relevant entities and individuals shall provide cooperation, and may not refuse or obstruct the performance.
In performing frontier health and quarantine duties, the Customs shall protect any trade secret, personal privacy, and personal information in accordance with the law, and shall not infringe upon the lawful rights and interests of relevant entities and individuals.
Article 7 The state adopts various measures to build the capability for public health at ports and continuously improve the effectiveness of the work relating to frontier health and quarantine.
Article 8 The state strengthens exchanges and cooperation with other countries or regions and relevant international organizations in the frontier health and quarantine field.
Chapter II Quarantine Inspection
Article 9 Persons, conveyances, containers and other transport equipment, goods, baggage, postal parcels, and other articles and packaging (collectively, "goods and articles") shall undergo quarantine inspection in accordance with the law upon entering or exiting the country. No entry or exit shall be allowed without the permission of the Customs.
A person enjoying diplomatic and consular privileges and immunities or other related treatment, or an article of an institution or person enjoying such privileges and immunities or other related treatment, that enters or exits the country shall undergo quarantine inspection in accordance with the law, without prejudice to the privileges and immunities enjoyed by the person or institution pursuant to the law.
Article 10 Persons, conveyances, goods, or articles that enter or exit the country shall undergo quarantine inspection at the first port of arrival and the last port of departure respectively; goods and articles may also undergo quarantine inspection at any other place designated by the Customs.
If a conveyance from abroad stops or lands in an area other than a domestic port due to force majeure or otherwise in an emergency, the person in charge of the conveyance shall immediately report to the nearest customs office, and the customs office receiving the report shall immediately send personnel to be present and handle the matter, and, when necessary, may request assistance from the disease prevention and control authority of the local people's government; except in an emergency or otherwise out of necessity, such conveyance shall neither load nor unload goods or articles, nor embark or disembark a person other than the pilot, without the permission of the Customs.
Article 11 The Customs may require a person entering or exiting the country to truthfully report his or her health status and related information and undergo a temperature check and medical inspection, and, if necessary, inspect his or her travel documents.
In addition to the quarantine inspection measures prescribed in the preceding paragraph, the Customs may implement the following quarantine inspection measures on the relevant person entering or exiting the country according to the circumstances:
(1) Requiring him or her to provide proof of vaccination or other prophylaxis and reviewing such proof.
(2) Conducting an epidemiological investigation and medical examination.
(3) Other quarantine inspection measures as prescribed by laws and administrative regulations.
If a foreigner entering the country refuses to undergo the quarantine inspection measures specified in this Article, the Customs may decide to deny him or her entry into the country while notifying the immigration authority.
Article 12 The Customs shall immediately take effective on-site prevention and control measures for a person determined as having contracted or being suspected of contracting a quarantinable infectious disease based on the quarantine inspection results provided by a quarantine doctor, and promptly notify the disease prevention and control authority of the local people's government at or above the county level in the place where the port is located. The disease prevention and control authority that receives the notification shall promptly organize the transportation of the person contracting or suspected of contracting a quarantinable infectious disease to a medical institution or any other facility designated by the local people's government at or above the county level for treatment in isolation or medical observation. The relevant medical institution or facility shall receive the person promptly.
If a person is likely to suffer from a monitored infectious disease, the Customs shall issue a medical convenience card and promptly notify the disease prevention and control authority of the local people's government at or above the county level in the place where the port is located. A medical institution shall give priority to diagnosing and treating the person with the medical convenience card.
