Measures for the Administration of New Products of Measuring Instruments
(Issued by Order No.68 of the State Administration for Market Regulation on March 16, 2023, and coming into force on June 1, 2023)
Chapter I General Provisions
Article 1 These Measures are developed in accordance with the Metrology Law of the People's Republic of China and the Detailed Rules for the Implementation of the Metrology Law of the People's Republic of China for purposes of regulating the administration of pattern approval for new products of measuring instruments.
Article 2 These Measures shall be observed in the manufacture within the territory of the People's Republic of China of new products of measuring instruments for the purpose of sales.
The term “new product of measuring instrument” means a measuring instrument that a producer has never produced before, including those whose performance and technical characteristics have been altered upon significant improvements in the structure and material of original products.
Article 3 Where a producer, for the purpose of sales, manufactures new products of measuring instruments that are listed in the Catalogue of Measuring Instruments Subject to Mandatory Administration and regulated through pattern approval, the products shall be subject to pattern approval by the provincial-level market regulation department before going into production.
A producer who manufactures measuring instruments other than those mentioned in the preceding paragraph may voluntarily authorize competent technical institutions to conduct pattern tests as required.
For new products of reference materials, the applicable provisions on the administration of reference materials shall be implemented.
Article 4 For the purpose of these Measures, the term "pattern approval” means an administrative licensing carried out by the market regulation department on whether the pattern of measuring instruments meets the statutory requirements.
“Pattern evaluation” means a technical evaluation of a prototype to determine whether the pattern of the measuring instrument meets the measurement requirements, technical requirements, and legal management requirements.
“Pattern test” means the test and inspection of the prototype of a measuring instrument according to relevant measurement technical specifications.
Article 5 The State Administration for Market Regulation shall be responsible for the supervision and administration of new products of measuring instruments nationwide. The provincial-level market regulation department shall be responsible for the supervision and administration of new products of measuring instruments within its jurisdiction.
Chapter II Application for Pattern Approval
Article 6 Where a producer manufactures the measuring instruments specified in paragraph 1 of Article 3 of these Measures, the producer shall apply for pattern approval to the provincial-level market regulation department where the measuring instruments are manufactured.
In applying for pattern approval, a producer shall submit the application materials as required by the market regulation department.
Article 7 Upon receipt of the application, the provincial-level market regulation department shall examine the application materials. If supplementary materials are required, or if the application does not comply with the legal form, the department shall notify the applicant in writing at one time of all the contents that need to be supplemented or corrected within five working days of receipt of the application materials.
If the examination is passed, the provincial-level market regulation department shall authorize a technical institution to conduct a pattern evaluation within five working days and notify the applicant.
Article 8 The technical institution responsible for pattern evaluation shall notify the applicant within five working days of receipt of the authorization from the provincial-level market regulation department.
Within five working days after receiving the notification from the institution responsible for pattern evaluation, the applicant shall submit to the institution the following technical documents, and be responsible for the authenticity and validity of the technical documents provided:
(1) Photographs of the prototype.
(2) Product standards (including inspection methods).
