Measures for the Administration of Pesticide Labels and Manuals (2017)

The Measures for the Administration of Pesticide Labels and Manuals, as deliberated and adopted at the 6th executive meeting of the Ministry of Agriculture in 2017, are hereby issued and shall come into force on August 1, 2017.

Measures for the Administration of Pesticide Labels and Manuals
Chapter I General Provisions
Article 1 For the purposes of regulating the administration of pesticide labels and manuals, and guaranteeing the safety of pesticide, these Measures are developed according to the Regulation on Pesticide Administration.
Article 2 Labels shall be printed or pasted to the package surface of pesticide products operated and used in the territory of China. If the size of packages is so small that it is unable to indicate the contents stipulated in these Measures, corresponding manuals shall be attached.
Article 3 For the purposes of these Measures, “labels and manuals” means all the manuals that are written on pesticide packages or attached to pesticide packages in the form of characters, drawings and symbols about pesticide contents.
Article 4 An applicant for pesticide registration shall submit a pesticide label sample and electronic document when applying for pesticide registration. For pesticides with manuals, sample documents and electronic documents shall be concurrently submitted.
Article 5 The pesticide labels and manuals shall be examined and approved by the Ministry of Agriculture (“MOA”). When approving pesticide registration, the MOA shall publish the content and date of approval of the approved pesticide labels and manuals.
Article 6 The contents in the labels and manuals shall be authentic, standardized and accurate, the characters, symbols and drawings therein shall be easy to identify and read, and shall not be revised or supplemented by pasting, cutting, alteration, or any other method.
Article 7 Standardized Chinese characters announced by the state shall be used on the labels and manuals, and Chinese Pinyin or other languages may be used simultaneously. The meanings expressed by other languages shall be consistent with those expressed by Chinese characters.
Chapter II Contents of Labels
Article 8 A pesticide label shall indicate the following contents:
(1) the name, dosage form, active ingredient and content of the pesticide;
(2) the pesticide registration certificate number, the product quality standard number and the pesticide production license number;
(3) the type of pesticide and its color strip, product performance, toxicity and identification;
(4) the scope of use, method of use, dosage, technical requirements for use and precautions;
(5) the first aid measures for poisoning;
(6) the storage and transportation methods;
(7) the production date, product batch number, quality guarantee period, and net content;
(8) the name and contact information of the holder of the pesticide registration certificate;
(9) the traceable electronic information code;
(10) the pictogram; and
(11) other contents required by the MOC to be indicated.
Article 9 In addition to the contents prescribed in Article 8, the following pesticide label contents shall also satisfy the corresponding requirements:
(1) The product of the original drug (parent drug) shall be marked with “This product is the raw material for the processing of pesticide preparations and shall not be used in crops or other places.” The technology and method of use shall not be indicated. However, those allowed to be directly used upon registration and approval are exceptions.
(2) Restricted use of pesticides shall be marked with “Restricted Use” and special restrictions and special requirements for use shall be indicated.
(3) The pesticide used for edible agricultural products shall be marked with a safe interval, except under the circumstances listed in subparagraph 3 of Article 18.
(4) The rodenticide product shall be marked with the prescribed rodenticide graphic.
(5) The sanitary pesticide for direct use is not required to contain any distinctive color strip.
(6) The label of the entrusted processing or sub-packaging of a pesticide shall also indicate the trustee's pesticide production license number, the name of the trustee and its contact information, and the date of processing and sub-packaging.
(7) A pesticide exported to China is not required be marked with a pesticide production license number, but shall be marked with the overseas production place, and the name and contact information of the office or agency established in China.
Article 10 Where the pesticide label is too small to indicate all the contents prescribed, the pesticide's name, active ingredient content, dosage form, pesticide registration certificate number, net content, production date, and quality assurance period, among others, shall be marked at a minimum, and the manuals shall be concurrently annexed. The manuals shall mark all the contents prescribed.
Where there is relatively wide scope of use registered and it is impossible to mark all the contents in the label, the scope of partial use shall be marked in the label, but the manual shall be annexed and all the use scope shall be marked.
Article 11 The name of pesticide shall be consistent with the name of the pesticide in the pesticide registration certificate.
Article 12 The contact information shall include the address of the holder of a pesticide registration certificate, enterprise or institution, postal code, contact phone number, and fax, among others.
Article 13 The “date of production” shall be indicated by the order of year, month and date, the year shall be indicated by four digits, and the month and the date shall be respectively indicated by two digits. Where the product batch number contains the production date, it may be combined with the production date.
