Measures for the Administration of Qualifications of Evaluation Entities of Geological Disaster Hazard
(Promulgated by Order No.29 of the Ministry of Natural Resources on May 20, 2005; amended for the first time in accordance with the Decision of the Ministry of Natural Resources on Amending Five Rules including the Measures for the Administration of Qualifications of Evaluation Entities of Geological Disaster Hazard adopted at the 2nd executive meeting of the Ministry of Natural Resources on May 6, 2015; and amended for the second time in accordance with the Decision of the Ministry of Natural Resources on the First Group of Repealed and Amended Departmental Rules adopted at the 2nd executive meeting of the Ministry of Natural Resources on July 16, 2019)
Chapter I General Provisions
Article 1 These Measures are formulated in accordance with the Regulation on the Prevention and Control of Geologic Disasters so as to strengthen the administration of eligibilities of evaluation entities of geologic disaster danger, regulate the market order of geologic disaster danger evaluation, and guarantee the quality of geologic disaster danger evaluation.
Article 2 These Measures shall apply to the applications for the eligibilities of evaluation entities of geologic disaster danger inside the territory of the People's Republic of China, and to the administration of the eligibilities of evaluation entities of geologic disaster danger.
Article 3 Geologic disaster danger evaluation as mentioned in these Measures shall mean the activities of evaluating the possibility of a construction project or an area under planning to suffer from such geologic disasters as landslip, landslide, mud-rock flow, ground collapse, ground crack, ground subsidence, etc. and the possibility of geologic disasters occurring in the process of project construction or after construction, and proposing specific prevention and treatment measures when carrying out the project construction and compiling an overall urban planning or village or town planning within the area where geologic disasters are easy to occur.
Article 4 The eligibilities of evaluation entities of geologic disaster danger shall be classified into three grades, namely Grade A, Grade B, and Grade C
Article 5 The responsibility to examine, approve and administer Grade A eligibilities of evaluation entities of geologic disaster danger shall remain with the Ministry of Natural Resources.
The responsibility to examine, approve and administer Grade B and Grade C eligibilities of evaluation entities of geologic disaster danger shall remain with the administrative department of natural resources of each province, autonomous region, or municipality directly under the Central Government.
Article 6 Only after obtaining the corresponding eligibility certificate in accordance with these Measures may an entity engaging in geologic disaster danger evaluation undertake geologic disaster danger evaluation within the scope permitted by the eligibility certificate.
An administrative department of natural resources at the county level or above shall take charge of supervising and inspecting the entities that engage in geologic disaster danger evaluation within its jurisdiction.
Chapter II Eligibility Grades and Business Scopes
Article 7 An evaluation entity of geologic disaster danger with Grade A eligibility shall meet the following conditions:
(1) It has no less than 50 technicians in engineering geology, hydrographic geology, environmental geology, or geotechnical engineering, etc., including no less than 15 technicians with senior technical titles who have engaged in geologic disaster investigation or geologic disaster prevention and control for five years or longer, and no less than 30 technicians with medium technical titles;
(2) It has independently undertaken no less than 15 projects of Grade II on geologic disaster danger evaluation within the latest two years, and has fine work achievements; and
(3) It has auxiliary technical equipment for field investigation of geologic disasters, measurement positioning, monitoring, testing, physical exploration, and computer plotting, etc.
Article 8 An evaluation entity of geologic disaster danger with Grade B eligibility shall meet the following conditions:
(1) It has no less than 30 technicians in engineering geology, hydrographic geology, environmental geology, or geotechnical engineering, etc., including no less than 8 technicians with senior technical titles who have engaged in geologic disaster investigation or geologic disaster prevention and control for five years or longer, and no less than 15 technicians with medium technical titles;
(2) It has independently undertaken no less than 10 projects on geologic disaster danger evaluation within the latest two years, and has fine work achievements; and
(3) It has auxiliary technical equipment for field investigation of geologic disasters, measurement positioning, testing, physical exploration, computer plotting, etc.
Article 9 An evaluation entity of geologic disaster danger with Grade C eligibility shall meet the following conditions:
(1) It has no less than 10 technicians in engineering geology, hydrographic geology, environmental geology, or geotechnical engineering, etc., including no less than 2 technicians with senior technical titles who have engaged in geologic disaster investigation or geologic disaster prevention and control for five years or longer, and no less than 5 technici......
