Measures for the Administration of the Qualification of Supervision Entities of Geologic Disaster Control Projects
(Promulgated by Order No.31 of the Ministry of Natural Resources on May 20, 2005; amended for the first time in accordance with the Decision of the Ministry of Natural Resources on Amending Five Rules including the Measures for the Administration of Qualifications of Evaluation Entities of Geological Disaster Hazard adopted at the 2nd executive meeting of the Ministry of Natural Resources on May 6, 2015; and amended for the second time in accordance with the Decision of the Ministry of Natural Resources on the First Group of Repealed and Amended Departmental Rules adopted at the 2nd executive meeting of the Ministry of Natural Resources on July 16, 2019)
Chapter I General Provisions
Article 1 The present Measures are formulated according to the Regulation on the Prevention and Control of Geologic Disasters in order to ensure the quality of geologic disaster control projects, control the project schedule, bring the benefits from the investment of control projects into full play and intensify the administration of the qualification of supervision entities of control projects.
Article 2 The present Measures shall apply to the applications for the qualification of supervision entities of geologic disaster control projects and the administration of the qualification of supervision entities of geologic disaster control projects within the territory of the People's Republic of China.
Article 3 Those entities that engage in the supervision of geologic disaster control projects shall, after acquiring the relevant qualification certificates of corresponding grades, undertake the supervision of geologic disaster control projects within the authorization as indicated in the qualification certificates thereof.
Article 4 The qualification of supervision entities of geologic disaster control projects shall be classified into three grades, namely, Grade A, Grade B and Grade C.
The Ministry of Natural Resources shall take charge of the examination and approval and administration of the qualification of supervision entities of geologic disaster control projects of Grade A.
The administrative departments of natural resources of all provinces, autonomous regions and municipalities directly under the Central Government shall take charge of the qualification of supervision entities of geologic disaster control projects of Grades B and C.
Chapter II Qualification Grades and Business Scope
Article 5 The standard for the qualification classification of supervision entities of geologic disaster control projects is as follows:
1. Grade A
(1) The total number of technicians for the supervision of geologic disaster control projects shall be no less than 30. In particular, the number of those special technicians majoring in hydrographical geology, engineering geology, environmental geology, geotechnical engineering and engineering budget, etc. shall be no less than 20.
(2) Having independently undertaken no less than 5 supervision programs for medium-sized geologic disaster control projects in the latest 3 years and having achieved good performance.
2. Grade B
(1) The total number of technicians for the supervision of geologic disaster control projects shall be no less than 20. In particular, the number of those special technicians majoring in hydrographical geology, engineering geology, environmental geology, geotechnical engineering and engineering budget, etc. shall be no less than 10.
(2) Having independently undertaken no less than 5 supervision programs for small geologic disaster control projects in the latest 3 years and having achieved good performance.
3. Grade C
The total number of technicians for the supervision of geologic disaster control projects shall be no less than 10. In particular, the number of those special technicians majoring in hydrographical geology, engineering geology, environmental geology, geotechnical engineering and engineering budget, etc. shall be no less than 5.
Article 6 Besides the qualification conditions as prescribed in Article 5 of the present Measures, an entity that applies for the supervision qualification of geologic disaster control projects shall, at the same time, meet the following requirements:
(1) Having the status of an independent legal person;
(2) Having a complete supervision and control system for security and quality management and having suffered no heavy safety or quality accident in the latest 5 years; and
(3) The external personnel shall not exceed 10% of the total number of technicians.
