Detailed Rules for the Implementation of the Regulation on the Administration of Sanitation in Public Places (2017 Amendment PKULAW Version) Detailed Rules for the Implementation of the Regulation on the Administration of Sanitation in Public Places (Issued by Order No. 80 of the Ministry of Health on March 10, 2011, amended in accordance with the Decision of the National Health and Family Planning Commission on Amending Eight Departmental Rules Including the Interim Measures for the Administration of Foreign Doctors' Temporary Practice of Medicine in China, Order No. 8 of the National Health and Family Planning Commission of the People's Republic of China on January 19, 2016, and amended according to The Decision of the National Health and Family Planning Commission to Amend Seven Departmental Rules Including the Administrative Measures for the Safety Review of New Food Raw Materials, Order No.18 of the National Health and Family Planning Commission, on December 26, 2017) Chapter I General Provisions Article 1 These Detailed Rules are developed in accordance with the provisions of the Regulation on the Administration of Sanitation in Public Places . Article 2 Public place operators shall, in their operations, abide by the laws, administrative regulations and departmental rules on health, as well as relevant health standards and rules, conduct the publicity of knowledge on sanitation in public places, prevent epidemic diseases and protect the health of the public, and provide a sound health environment for customers. Article 3 The National Health and Family Planning Commission shall take charge of the supervision and administration of sanitation in public places nationwide. The administrative departments of health and family planning of local people's governments at or above the county level shall take charge of the supervision and administration of sanitation in public places within their respective administrative regions. The entry-exit inspection and quarantine institutions shall conduct the supervision and administration of sanitation in national borders, ports and inbound and outbound means of transport in accordance with the provisions of relevant laws and regulations. Competent health departments of railway administrations shall take charge of the supervision and administration of sanitation in train stations, waiting rooms and railway carriages within their respective jurisdictions, and public places in which services are mainly provided to railway personnel. Article 4 The administrative departments of health and family planning of local people's governments at or above the county level shall, based on the requirements for the supervision and administration of sanitation in public places, establish and improve the team for the supervision of sanitation in public places and the system for monitoring sanitation in public places, make the plan for the supervision of sanitation in public places, and organize the implementation of the plan. Article 5 Industry organizations of public places are encouraged and supported in conducting self-discipline education, directing public place operators to conduct business operations in accordance with the law, advancing good faith in the industry, and publicizing and popularizing the knowledge on sanitation in public places. Article 6 Any entity or individual has the right to report any violation of these Detailed Rules. The administrative department of health and family planning that receives the report shall conduct investigation and handle the report in a timely manner, and give a reply in accordance with relevant provisions. Chapter II Sanitation Management Article 7 The legal representative or person in charge of a public place is the primary person in charge of the sanitary safety of the business premises. A public place operator shall establish a sanitation management department or assign full- or part-time sanitation management personnel to be specially responsible for sanitation in the public place, and establish and improve sanitation management rules and sanitation management archives. Article 8 The archives on the management of sanitation in a public place shall mainly cover the following content: (1) Setup of the sanitation management department and personnel, and sanitation management rules. (2) Testing results of air quality, microclimate (humidity, temperature, wind speed), water quality, natural light, lighting and noise level. (3) Cleaning, disinfection, replacement and testing of utensils for customers. (4) Use, maintenance and inspection of sanitation facilities. (5) Cleaning and disinfection of the central air conditioning and ventilation system. (6) Arrangements for health inspection and training and assessment of employees. (7) Management of demanding vouchers in the purchase of public sanitation items. (8) Emergency response plan or solution for health hazard incidents in the public place. (9) Other recorded information as required by the administrative department of health and family planning of the province, autonomous region or municipality directly under the Central Government. The archives on the management of sanitation in the public place shall be managed by a special person, and records shall be categorized and retained for at least two years. Article 9 A public place operator shall establish sanitation training rules, organize employees to learn relevant sanitation legal knowledge and knowledge on the sanitation of the public place, and organize examination. Those who fail to pass the examination shall not assume posts. Article 10 A public place operator shall arrange an annual health examination of employees, and employees may assume their posts only after obtaining a valid health certificate. Any person with an infectious disease of the digestive tract such as dysentery, typhoid fever, viral hepatitis A or viral hepatitis E, or any person suffering from active tuberculosis or suppurative or exudative skin disease shall not directly serve customers until he or she has fully recovered. Article 11 A public place operator shall ensure that the air in the public place is well ventilated. Indoor air quality shall comply with national health standards and requirements. A public place using a central air conditioning and ventilation system shall comply with the requirements of health standards and provisions for central air conditioning and ventilation systems in public places. Article 12 Drinking water supplied to customers by public place operators shall comply with the requirements of national health standards for drinking water . The water quality of swimming pools and public bathhouses shall comply with national health standards and requirements. Article 13 Public place lighting and noise levels shall comply with national health standards and requirements. Natural light should be used for public places whenever possible. When natural light is inadequate, public place operators shall install lighting facilities commensurate with the scale of the public place. Public place operators shall take measures to reduce noise. Article 14 Public place operators shall ensure the sanitary safety of the utensils provided to customers for use. Utensils for repeated use shall be changed for each customer, and washed, disinfected and maintained clean in accordance with relevant health standards and requirements. The repeated use of disposable utensils is prohibited. Article 15 A public place operator shall install facilities and equipment for cleaning, disinfection, maintaining cleanliness and washing as well as public restrooms commensurate with the business scale and items.
