Regulations of the People's Republic of China on Registered Architects (2019 Revision)
Regulations of the People's Republic of China on Registered Architects
(Issued by Decree No. 184 of the State Council of the People's Republic of China on September 23, 1995; amended in accordance with the Decision of the State Council to Amend Some Administrative Regulations by Order No. 714 of the State Council on April 23, 2019)
Chapter I : General Provisions
Article 1 These Regulations are formulated for the purpose of strengthening the administration of registered architects, improving the quality and level of architectural design, ensuring the safety of the lives and property of citizens and protecting the public interests of society.
Article 2 Registered architects mentioned in these Regulations refer to those who have lawfully acquired a certificate of a registered architect and are engaged in the architectural design of buildings or a related profession.
Registered architects are composed of Grade - 1 and Grade - 2 registered architects.
Article 3 These Regulations shall apply to the examination, registration and practice of registered architects.
Article 4 The competent departments of construction administration and personnel administration of the State Council and the competent departments of construction administration and personnel administration of the local people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall direct and supervise the examination, registration and practice of registered architects in accordance with the provisions prescribed in these Regulations.
Article 5 The National Administration Board of Architectural Registration and the administration boards of architectural registration in provinces, autonomous regions and municipalities directly under the Central Government shall, in accordance with the provisions prescribed in these Regulations, be responsible for the specific work of the examination and registration of registered architects.
The National Administration Board of Architectural Registration shall consist of the representatives of the competent departments of construction administration, personnel administration and other relevant administrative departments of the State Council, and architectural design experts.
The administration boards of architectural registration in provinces, autonomous regions and municipalities directly under the Central Government shall consist of the representatives of the competent departments of construction administration, personnel administration and other relevant administrative departments of the provinces, autonomous regions and municipalities directly under the Central Government, and architectural design experts.
Article 6 Registered architects may establish professional associations of registered architects to protect their lawful rights and interests.
Chapter II: Examination and Registration
Article 7 The State shall implement a system of unified nationwide qualification examinations for registered architects. The measures of the unified nationwide qualification examinations for registered architects shall be formulated by the competent department of construction administration of the State Council jointly with the competent department of personnel administration of the State Council after consultation with other relevant administrative departments of the State Council, and shall be organized and implemented by the National Administration Board of Architectural Registration.
Article 8 Whoever meets one of the following conditions may apply for participating in the qualification examination for Grade-I registered architects:
(1) He or she has a master's degree or above in architecture, or a doctor's degree of engineering in a closely related specialty, and has engaged in architectural design or the relevant business for two years or more;
(2) He or she has a bachelor's degree in architecture or a master's degree of engineering in a closely related specialty and has engaged in architectural design or the relevant business for three years or more;
(3) He or she has completed undergraduate programs in architecture and has engaged in architectural design or the relevant business for five years or more, or has completed undergraduate programs in a specialty closely related to architecture and has engaged in architectural design or the relevant business for seven years or more;
(4) He or she has the technical title of senior engineer and has engaged in architectural design or the relevant business for three years or more, or has the technical title of engineer and has engaged in architectural design or the relevant business for five years or more;
(5) He or she has outstanding achievements in design, which reaches the professional level prescribed in the preceding four subparagraphs as recognized by the National Administration Board of Architectural Registration, although he or she does not meet the conditions prescribed in the preceding four subparagraphs.
The personnel prescribed in subparagraphs (3) through (5) of the preceding paragraph shall obtain a bachelor's degree.
Article 9 Those who meet one of the following requirements may apply to take part in the qualification examination for Grade - 2 registered architects:
(1) in possession of an undergraduate education or above in architecture or in a closely related specialty and at least two years' work experience in architectural design or a related profession;
(2) in possession of an educational qualification at or above the level of higher learning in architectural design technology or in a closely related specialty and at least three years' work experience in architectural design or a related profession;
(3) in possession of an educational background from a 4 - year secondary specialized school or above in architectural design technology and at least five years' work experience in architectural design or a related profession;
