Regulation on Urban Water Supply (2020 Revision)

Chapter I General Provisions

Article 1 This Regulation is formulated for the purposes of strengthening the administration of urban water supply, developing the urban water supply undertaking, and ensuring the water supply for everyday life, production activities and various constructions.

Article 2 For the purpose of this Regulation, “urban water supply” means urban public water supply and water supply from self-constructed facilities.

For the purpose of this Regulation, “urban public water supply” means the supply of water by urban water utilities for the everyday life, production activities and various constructions of entities and residents through public water supply pipelines and the auxiliary facilities thereof.

For the purpose of this Regulation, “water supply from self-constructed facilities” means the supply of water by urban water users for their own everyday life, production activities and various constructions through their self-constructed water supply pipelines and the auxiliary facilities thereof.

Article 3 Entities and individuals engaged in urban water supply and use of water supplied to urban areas must observe this Regulation.

Article 4 Urban water supply shall follow the principles of “combining the exploitation of water sources with planned water use and water conservation.”

Article 5 The people's governments at or above the county level shall incorporate the urban water supply undertaking into their plans for economic and social development.

Article 6 The state will implement the policies that are conducive to the development of urban water supply, encourage scientific and technological research on urban water supply, promote advanced technologies, and enhance the modernization of urban water supply.

Article 7 The administrative department of urban construction of the State Council shall be in charge of urban water supply across the country.

The administrative departments of urban construction of the people's governments of provinces and autonomous regions shall be in charge of urban water supply within their respective administrative regions.

The administrative department of urban water supply determined by the people's government of a city at or above the county level (hereinafter referred to as “administrative department of urban water supply”) shall be in charge of urban water supply within its administrative regions.

Article 8 Entities and individuals that have made outstanding achievements in urban water supply shall be rewarded.

Chapter II Water Sources for Urban Water Supply

Article 9 The people's government of a city at or above the county level shall organize the administrative department of urban planning, water administrative department, administrative department of urban water supply, administrative department of geology and mineral resources and other appropriate administrations to jointly prepare a water source development and utilization plan for urban water supply and, as an integral part of its urban water supply development plan, incorporate it into its urban comprehensive plan.

Article 10 A water source development and utilization plan for urban water supply shall be prepared from the needs of urban development and coordinate with the overall water resource plan and the long-term water supply and demand plan.

Article 11 A water source development and utilization plan for urban water supply shall be prepared according to local circumstances, and the use of surface water and groundwater shall be reasonably arranged.

Article 12 In the preparation of a water source development and utilization plan for urban water supply, priority shall be given to ensuring urban domestic water, with due regard to overall arrangements for the use of water for industrial activities and other various constructions.

Article 13 The environmental protection department of a local people's government at or above the county level shall, in conjunction with the administrative department of urban water supply, water administrative department, health administrative department and other appropriate departments, jointly delimit the drinking water source protection areas, and make an announcement thereon after approval by the people's government at the same level. The delimitation of drinking water source protection areas across provinces, cities, and counties shall be jointly determined through consultation among relevant people's governments and announced after the approval of the common people's governments at a higher level.

Article 14 In drinking water source protection areas, all activities that pollute water quality shall be prohibited.
