Regulation on the Personnel Management of Public Institutions
Order of the State Council of the People's Republic of China

The Regulation on the Personnel Management of Public Institutions, as adopted at the 40th executive meeting of the State Council on February 26, 2014, is hereby issued, and shall come into force on July 1, 2014.

Chapter I General Provisions
Article 1 This Regulation is developed to regulate the personnel management of public institutions, guarantee the lawful rights and interests of employees of public institutions, build a high-quality work team of public institutions, and promote the development of public services.
Article 2 The personnel management of public institutions shall follow the principles of administration of officers and talent by the Party, and the guidelines of democracy, openness, competition and selecting the best shall be implemented in a comprehensive and accurate manner.
The state conducts graded and categorized administration of employees of public institutions.
Article 3 The comprehensive personnel administrative departments of public institutions directly under the Central Government shall be responsible for the comprehensive personnel management of public institutions across the country.
The local comprehensive personnel administrative departments of public institutions at or above the county level shall be responsible for the comprehensive personnel management of public institutions within their respective jurisdictions.
The competent departments of public institutions shall be specifically responsible for the personnel management of their affiliated public institutions.
Article 4 Public institutions shall establish and improve personnel management rules.
Public institutions that plan to develop or amend personnel management rules shall solicit the opinions of their employees through the employees' congress or by other means.
Chapter II Position Arrangement
Article 5 The state shall establish post management rules for public institutions, and specify post categories and grades.
Article 6 Public institutions shall, as required for their functions, tasks and work, set up positions according to the relevant provisions of the state.
There shall be specific names, functions and tasks, work standards and office conditions for the posts.
Article 7 Public institutions shall submit the drafted position arrangement plan to the comprehensive personnel administrative departments for recordation.
Chapter III Open Recruitment and Competition for a Post
Article 8 A public institution shall hire new employees from the public, except those assigned according to state policies, appointed by superior authorities according to the personnel management authority, or assigned to posts involving confidential information.
Article 9 A public institution shall hire employees from the public under the following procedures:
(1) Preparation of the open recruitment plan.
(2) Issuance of recruitment information such as vacant positions and qualification conditions.
(3) Examination of candidates' qualification conditions.
(4) Examination and inspection.
(5) Physical check-up.
(6) Announcement of the list of prospective employees.
(7) Conclusion of employment contracts and handling of employment formalities.
Article 10 Where an eligible person holding a post of a public institution needs to be selected from its employees through competition, the competition for the post shall be conducted under the following procedures:
(1) Preparation of the plan on the competition for the post.
(2) Issuance of such information as vacant positions, qualification conditions and employment term in the institution.
(3) Examination of candidates' qualification conditions.
(4) Examination and evaluation.
(5) Announcement of the list of prospective employees in the institution.
(6) Handling of employment formalities.
Article 11 The exchange of employees of public institutions may be conducted according to the relevant provisions of the state.
