Measures for the Administration of Energy Conservation of Major Energy-Consuming Entities (2018 Revision) Order of the National Development and Reform Commission, the Ministry of Science and Technology, the People's Bank of China, the State-Owned Assets Supervision and Administration Commission of the State Council, the General Administration of Quality Supervision, Inspection and Quarantine, the National Bureau of Statistics, and the China Securities Regulatory Commission (No. 15) For the purposes of tightening the administration of energy conservation of major energy users and raising the efficiency of energy utilization, we have revised the Measures for the Administration of Energy Conservation of Major Energy-Consuming Entities , which are hereby issued and shall come into force on May 1, 2018. Thereupon, the Measures for the Administration of Energy Conservation of Major Energy-Consuming Entities (Order No. 7, State Economic and Trade Commission of the People's Republic of China) issued by the former State Economic and Trade Commission on March 10, 1999 shall be concurrently repealed. Annex: Measures for the Administration of Energy Conservation of Major Energy-Consuming Entities He Lifeng Director of the National Development and Reform Commission Wan Gang Minister of Science and Technology Zhou Xiaochuan President of the People's Bank of China Xiao Yaqing Chairman of the State-Owned Assets Supervision and Administration Commission of the State Council Zhi Shuping Director of the General Administration of Quality Supervision, Inspection and Quarantine Ning Jizhe Director of the National Bureau of Statistics Liu Shiyu Chairman of the China Securities Regulatory Commission February 22, 2018 Measures for the Administration of Energy Conservation of Major Energy-Consuming Entities Chapter I General Provisions Article 1 For the purposes of tightening the administration of energy conservation of major energy users, raising the efficiency of energy utilization, controlling total energy consumption, and furthering the building of ecological civilization, these Measures are developed according to the Energy Conservation Law of the People's Republic of China and other laws and regulations. Article 2 For the purpose of these Measures, "major energy-consuming entity" means: (1) an energy-consuming entity whose annual energy consumption is 10,000 tons of standard coal or more; or (2) an energy-consuming entity whose annual energy consumption is not less than 5,000 tons of standard coal but not more than 10,000 tons of standard coal and which is designated by the relevant department of the State Council, or the department administering energy conservation of the people's government of a province, autonomous region, or municipality directly under the Central Government. The accounting entities for energy consumption are corporate entities. Article 3 A major energy-consuming entity shall implement the laws, regulations, rules, policies, and standards issued by the local governments and the state in relation to energy conservation, according to the principle of reasonable energy consumption, tighten the management of energy conservation, reduce energy consumption, and accept the administration by the department administering energy conservation of the people's government at or above the county level in the place in which it is located. Article 4 The National Development and Reform Commission ("NDRC") shall be responsible for the administration of energy conservation of major energy-consuming entities across the country. The relevant departments of the State Council shall carry out the energy conservation of major energy-consuming entities within the scope of their respective functions and duties. The departments administering energy conservation of the local people's governments at or above the county level shall be responsible for the administration of energy conservation of major energy-consuming entities within their respective administrative regions. The relevant departments of the local people's governments at or above the county level shall administer the energy conservation of major energy-consuming entities within the scope of their respective functions and duties. The departments administering energy conservation of the local people's governments at or above the county level shall, in the course of the administration of energy conservation of major energy-consuming entities, based on the situation of the industries in which local major energy-consuming entities operate, maximize the role of the relevant competent departments of industry so as to jointly promote the administration of energy conservation of major energy-consuming entities. Article 5 Major energy-consuming entities shall be subject to the energy conservation objective responsibility system and the energy conservation evaluation and assessment regime. The departments administering energy conservation of the local people's governments at or above the prefecture city level shall, jointly with the relevant departments, break down the objectives of total energy consumption control and energy conservation by major energy-consuming entities, carry out energy conservation objective responsibility assessment and evaluation of major energy-consuming entities at different levels, mainly evaluate the accomplishment of the objectives of total energy consumption control and energy conservation, efficiency of energy utilization, and implementation of energy conservation measures by major energy-consuming entities, submit the evaluation results step by step, and release the results to the public. Chapter II Management Measures Article 6 A major energy-consuming entity shall develop and implement an energy conservation plan and energy conservation measures each year to ensure the accomplishment of the objectives of total energy consumption control and energy conservation. The energy conservation measures shall be technologically feasible and financially reasonable. Article 7 A major energy-consuming entity shall establish and improve energy management rules, specify energy management duties, develop the management requirements or specifications for the whole process of energy utilization, determine management mechanisms in withdrawing outdated technology, improving energy conservation technology, reward and punishment, and all other aspects, tighten the management of energy conservation, reduce energy loss, and raise the efficiency of energy utilization. Article 8 A major energy-consuming entity shall establish an energy conservation objective responsibility system, according to the objectives of and the tasks and requirements for total energy consumption control and energy conservation assigned by the department administering energy conservation of the government, scientifically assess energy conservation potential, reasonably break down the objectives, assign them to the corresponding levels or posts, and regularly organize internal evaluation. A major energy-consuming entity shall establish reward and punishment rules for energy conservation and link the accomplishment of the objectives of total energy consumption control and energy conservation to reward and punishment, so as to commend and reward the individuals and teams with outstanding performance in energy conservation and punish the individuals and teams wasting energy. Article 9 A major energy-consuming entity shall, according to the Energy Management Systems—Requirements and other relevant standards, establish and improve an energy management system and ensure its effective operation. The departments administering energy conservation of the people's governments at or above the county level shall be responsible for the organization and conduct of the assessment of the building effect of energy management systems. A major energy-consuming entity shall be encouraged to have its energy management system certified. Article 10 A major energy-consuming entity shall establish a leading group for energy conservation headed by the primary leader of the entity. A major energy-consuming entity shall employ a person with expertise in energy conservation, practical experience, and a medium or higher technical title to take charge of energy management. A major energy-consuming entity shall specify an energy management department, establish energy management posts, and employ competent energy management personnel.
