Regulations on the Administration of City Appearance and Environmental Sanitation (2017 Amendment)
Regulations on the Administration of City Appearance and Environmental Sanitation
(Issued by Order No. 101 of the State Council of the People's Republic of China on June 28, 1992 ; and amended for the first time according to the Decision of the State Council on Repealing and Amending Some Administrative Regulations (Order No. 588 of the State Council) on January 8, 2011; and amended for the second time in accordance with The Decision of the State Council to Amend and Repeal Certain Administrative Regulations on March 1, 2017)
Chapter I General Provisions
Article 1 For the purpose of strengthening the administration of city appearance and environmental sanitation, creating a clean and beautiful urban work and living environment, and promoting the building of socialist material civilization and spiritual civilization in cities, these Regulations are developed.
Article 2 All entities and individuals in cities of the People's Republic of China shall comply with these Regulations.
Article 3 The work of city appearance and environmental sanitation shall be carried out under the principle of combining unified leadership, divisional responsibilities, and management by professionals, with management by the masses.
Article 4 The competent urban construction administrative department under the State Council shall be responsible for the work of city appearance and environmental sanitation in all localities.
The competent urban construction administrative departments of the people's governments of the provinces and autonomous regions shall be responsible for the administration work of city appearance and environmental sanitation within their respective administrative regions.
The competent city appearance and environmental sanitation administrative departments of the people's governments of the cities shall be responsible for the administration work of city appearance and environmental sanitation within their respective administrative regions.
Article 5 A municipal people's government shall incorporate the cause of city appearance and environmental sanitation into the national economic and social development plan and organize the implementation thereof.
A municipal people's government shall, in combination with the local reality, actively promote the reform of the system of employment for environmental sanitation and take measures to gradually raise the salaries and benefits of environmental sanitation workers.
Article 6 A municipal people's government shall strengthen the publicity of the scientific knowledge of city appearance and environmental sanitation, raise the environmental sanitation consciousness of the citizens, and develop positive sanitation habits.
All entities and individuals shall respect the work of city appearance and environmental sanitation workers and shall not impede or obstruct the performance of duties by city appearance and environmental sanitation workers.
Article 7 The state shall encourage the scientific and technological research on city appearance and environmental sanitation, promote the advanced technologies, and raise the level of city appearance and environmental sanitation.
Article 8 Entities and individuals with outstanding achievements in the work of city appearance and environmental sanitation shall be rewarded by people's governments.
Chapter II Management of City Appearance
Article 9 The buildings and facilities in cities shall comply with the standards for city appearance as prescribed by the state. Cities open to the outside world, scenic-tourist cities and other cities that meet the conditions may, in light of the actual local conditions, develop standards on city appearance which are stricter than those as prescribed by the state; and the city appearance of towns that have developed the organic-township system may be governed by the standards on city appearance as prescribed by the state.
Article 10 All entities and individuals shall keep the buildings neat and beautiful. Objects hindering city appearance shall not be piled or hung in balconies or outside the windows along the streets as specified by municipal people's governments. Balconies shall be constructed or enclosed under the relevant provisions of the competent city appearance and environmental sanitation administrative departments of municipal people's governments.
Article 11 Outdoor advertising, placards, galleries, showcases, etc. installed in cities shall be featured with healthy contents and beautiful appearance and shall be regularly fixed, decorated or dismantled.
To install a large-scale outdoor advertising, the consent of a competent city appearance and environmental sanitation administrative department of a municipal people's government shall be obtained and the formalities of approval shall be undergone under relevant provisions.
Article 12 Municipal public facilities in cities shall be in harmony with the surrounding environment, and shall be maintained in a sound, clean, and tidy condition.
Article 13 In front of the buildings on both sides of the main streets, the walls, fences or hedges, flower beds (ponds), and lawns, etc., shall be used as boundaries, where it is necessary and possible, in the form of diorama or semi-diorama.
Trees, hedges, flower beds (pools), lawns, etc. along streets, shall be kept clean and beautiful. Residue dirt, branches and leaves, etc., left from cultivation, renovation or other operation shall be removed in a timely manner by management entities, individuals, or operators.
Article 14 No entity or individual may pile materials, construct buildings, structures or other facilities on both sides of streets and at public sites. To pile materials, construct non-permanent buildings, structures or other facilities on either side of a street or at a public site for construction or other special needs, the consent of the competent city appearance and environmental sanitation administrative department of the municipal people's government shall be obtained and the formalities of approval shall be undergone under relevant provisions.
Article 15 Transportation tools operating in the urban areas shall be kept in good shape and clean, and the liquid and bulk cargoes transported in freight vehicles shall be sealed, wrapped and covered so as ......
