Regulations on Urban Landscaping (2017 Revision)
Regulations on Urban Landscaping
(Issued by Order No. 100 of the State Council of the People's Republic of China on June 22, 1992, and revised for the first time according to the Decision of the State Council on Repealing and Amending Some Administrative Regulations on January 8, 2011, and revised for the second time according to Decision of the State Council to Amend and Repeal Certain Administrative Regulations on March 1, 2017 )
Chapter I General Provisions
Article 1 For the purpose of promoting the development of the urban landscaping undertaking, improving the ecological environment, beautifying the living environment, and enhancing people's physical and mental health, these Regulations are developed.
Article 2 These Regulations shall apply to the planning, construction, protection and management of urban landscaping such as planting and conservation of trees, flowers, and plants in urban planned areas.
Article 3 A municipal people's government shall incorporate urban landscaping construction into its national economic and social development plans.
Article 4 The state shall encourage and strengthen the scientific research of urban landscaping, popularize advanced technologies, and improve the scientific, technical and artistic level of urban landscaping.
Article 5 Entities and citizens with capacity to work in cities shall perform tree planting or other landscaping obligations in accordance with the relevant provisions of the state.
Article 6 Entities and individuals with outstanding achievements in the work of urban landscaping shall be commended and rewarded by the people's government.
Article 7 The State Council shall establish a National Forestation Commission to uniformly organize and lead the urban and rural landscaping work in all localities, and its office shall be located in the competent forestry administrative department under the State Council.
The competent urban construction administrative department under the State Council, the competent forestry administrative department under the State Council, and other departments shall, according to their respective functions and powers as prescribed by the State Council, be responsible for the work of urban landscaping in all localities.
The local landscaping management system shall be specified by a people's government of a province, autonomous region, or municipality directly under the Central Government in light of the actual local circumstances.
A competent urban landscaping administrative department of a municipal people's government shall be responsible for the work of urban landscaping in the urban planned area within its respective administrative region.
Within an urban planned area, the landscaping work subject to the administration of a competent forestry administrative department as prescribed in relevant laws and regulations shall be implemented under relevant laws and regulations.
Chapter II Planning and Construction
Article 8 A municipal people's government shall organize a competent urban planning administrative department, a competent urban landscaping administrative department, and other departments to jointly develop an urban landscaping plan and incorporate it into its general urban planning.
Article 9 An entity that develops an urban landscaping plan shall start from the reality, and rationally arrange the urban landscaping area corresponding to the urban population and the urban area according to the needs of urban development.
Per capita urban public green area, green coverage rate, and other planning indicators shall be prescribed by the competent urban construction administrative department under the State Council according to the nature, scale, natural conditions, and other actual conditions of different cities.
Article 10 An entity that develops an urban landscaping plan shall, in accordance with local characteristics, utilize the original terrain, landform, water body, vegetation, historical and cultural sites, and other natural and cultural conditions, and rationally arrange public green belts, green belts in residential areas, protection green belts, production green belts, scenic woodland, etc., under the principle of providing convenience to the general public.
Article 11 The design of urban landscaping projects shall be entrusted to design entities with corresponding qualification certificates.
An ancillary landscaping project design plan of an engineering construction project shall be subject to the examination with the involvement of the competent urban landscaping administrative department of a municipal people's government when it is undergoing the formalities for the examination and approval of basic constructi......
