The newly revised Measures for Lump-sum Compensation to the Disabled or Deceased Employees of Entities Involving Illegal Employment, which were adopted at the 56th executive meeting of the Ministry of Human Resources and Social Security, are hereby issued and shall come into force on January 1, 2011. The Measures for Lump-sum Compensation to the Disabled or Deceased Employees of Entities Involving Illegal Employment issued by the Ministry of Labor and Social Security on September 23, 2003 shall be abolished concurrently.

Measures for Lump-sum Compensation to the Disabled or Deceased Employees of Entities Involving Illegal Employment
Article 1 These Measures are formulated under the authorization of paragraph 1 of Article 66 of the Regulation on Work-related Injury Insurance .
Article 2 The term “disabled or deceased employees of entities involving illegal employment” as mentioned in these Measures means the employees in an entity which has no business license, or has not been registered or filed in accordance with the law, or whose business license has been revoked in accordance with the law, or whose registration or filing has been cancelled, who is injured in an accident or contracts an occupational disease, or a child laborer who is disabled or deceased because of being employed by such an entity.
The entities as mentioned in the preceding paragraph must, in accordance with these Measures, pay compensation in a lump sum to the disabled employee or the close relatives of the deceased employee, or the disabled child laborer or the close relatives of the deceased child laborer.
